જીવન એક ખેતર છે. તે જૂઠું નહીં બોલે.

તમે એને જેટલું આપો તેનાથી સોગણું કરીને તે પાછું આપે,

પણ તમે કશું નહીં આપો તો એની પાસેથી તમને કશું નહીં મળે.

જીવન ખોટું લગાડતું નથી અને ખુશામત પણ કરતું નથી. ચોખ્ખો હિસાબ છે,

જેવું આપો તેવું મળે. જીવનને તમે શું શું આપ્યું છે ?

સાચું કહો. જીવન પ્રત્યે તમને અવિશ્વાસ છે, કંજુસાઈ છે, નફરત છે.

ઓછામાં ઓછું આપો અને ન છૂટકે આપો પછી જીવનમાં સારાપાકની આશા કેમ રખાય ?

તમે ફરિયાદ કરો છો કે તમારું ભાગ્ય ઊઘડ્યું નહિ,

જીવન ફળ્યું નહિ, તમે છેતરાયા છો, ભરમાયા છો, પણ તમારી ફરિયાદ સાચી નથી.

ધરતી છેતરતી નથી. જીવન છેતરતું નથી. જીવન જૂઠું બોલતું નથી.

જીવન તમને ફક્ત યાદ દેવરાવે છે કે તમે કશું આપ્યું જ નથી.

ક્યાં પ્રેમ કર્યો છે, ક્યાં સાહસ કર્યું છે, ક્યાં ભોગ આપ્યો છે, ક્યાં

શ્રદ્ધા રાખી છે ?

તમે ઝંપલાવ્યું નથી, અજમાવ્યું નથી, જીવન હોડમાં મૂક્યું નથી.

પછી બદલામાં શું મળે ?

તમે તમારી નિરાશા બતાવો એમાં તમે તમારા જીવનનો ગૂનો કબૂલ કરો છો અને જાહેર કરો

છો.

કારણ કે તમે જીવનમાં ખરેખર સાચી મૂડી રોકી હોત તો એનું મબલક વ્યાજ તો તમને મળી

ચૂક્યું હોત.

જીવન જૂઠું બોલતું નથી.

નસીબથી મળી છે જીંદગી તો એને જીવી જાણો

લાંબી આ સફરમાં જીંદગીના ઘણા રૂપ જોયા છે

તમે એકલા શાને રડો છો, સાથી તો અમેય ખોયા છે

આપ કહો છો આમને શું દુઃખ છે, આ તો સદા હસે છે

અરે! આપ શું જાણો આ સ્મિતમા કેટલા દુઃખ વસે છે

મંઝીલ સુધી ના પહોંચ્યા તમે એ વાતથી દુઃખી છો

અરે! ચાલવા મળ્યો રસ્તો તમને, એટલા તો સુખી છો

આપને ફરિયાદ છે કે કોઇને તમારા વિશે સુઝ્યુ નથી

અરે! અમને તો “કેમ છો?” એટલુંય કોઈએ પુછ્યું નથી.

જે થયું નથી એનો અફસોસ શાને કરો છો,

આ જીંદગી જીવવા માટે છે, આમ રોજ રોજ શાને મરો છો?

આ દુનિયામા સંપુર્ણ સુખી તો કોઈ નથી

Whiille the BSNL iis procuriing Tellecom equiipments/materiialls ffrom the market iits seven
manuffacturiing uniits are iignored ffor that matter.. Neiither utiilliized theiir present capabiilliity off
productiion capaciity nor they are upgraded to meet the present requiirement iin hiigher
technollogy.. TFs are giiven yearlly productiion target but requiisiitiions ffrom ciirclles are llackiing.. They
are llackiing a proper diirectiion iin thiis regard.. IIn the drafft Natiionall Tellecom Polliicy 2011
iimportance has been giiven ffor meetiing Eiighty Percent Tellecom Sector Demand through
Domestiic Manuffacturiing and Promotiing iindiigenous R&D,, iinnovatiion and manuffacturiing that
serve domestiic and fforeiign markets.. The BSNL shoulld allso take part iin thiis endeavour..
We suggest to have a proper diirectiion towards manuffacturiing off type off equiipments iin TFs..
• As a short term measure,, the products whiich can be produced iin the TFs wiithiin the lliimiit off
technollogy avaiillablle wiith them at present shoulld be ordered on TFs ffor 100% requiirement off
ciirclles and none off the ciirclles shoulld be allllowed procurement ffrom market tiillll the TFs are
iissued No Objjectiion..
• Orders ffor manuffacturiing and iinstallllatiion off Towers obtaiined by BSNL ffrom DOT under USO
projjects shoulld be pllaced on TFs to meet theiir capaciity..
• Compllete Towers or sorts and a huge quantiity off components,, costiing about more or lless 100
Cr..,, are llyiing wiith ffactoriies ((Riichhaii,, Bhiillaii,, Gopallpur,, Kharagpur etc)) as iinventory.. IIff
requiisiitiions are not receiived these wiillll be diisposed off as scrap materiiall iincurriing lloss to BSNL..
So,, arrangement to be made to utiilliize these materiiall iin the ffiielld beffore they are decllared
scrap..
• Proposall ffor manuffacturiing off VRLA Batteriies off sorts and Modem and other materiialls ffrom
diifffferent TFs fforwarded to C O ffor approvall shoulld be clleared wiithout any ffurther dellay..
• Effffort shoulld be made to enhance productiion capaciity off manuffacturiing HDPE Duct
iimmediiatelly..
• As a llong term measure,, the manuffacturiing uniits are to be upgraded by proviidiing llatest
technollogy to ffaciilliitate manuffacturiing off materiialls ffor the serviices off Mobiille as wellll as BB.. For
thiis purpose iit iis suggested that
a)) R &D sectiion off the TFs shoulld be reviived wiith a viiew to earniing capabiilliity off produciing
materiialls off llatest technollogy beiing used iin Mobiille and Broad Band serviices;; ffor thiis
purpose diirect recruiit JJTOs to be posted iin TFs..
b)) Effffort shoulld allso be made to get iin touch wiith other R&D organiizatiions under DOT e..g.. C
DOT,, TEC and allso wiith IITII to obtaiin technollogy and consulltatiion ffor equiipments
manuffacturiing..
2.. Restructuriing off IIndustriiall cadre
On iintroductiion off new technollogy the ffiielld staffff have been giiven ffaciilliity off upgradatiion off skiillll
through restructuriing off cadre but the same has not been extended to IIndustriiall cadres iin TFs..
The Executiives iin the Engg.. Cadres have allso been upgraded to those iin the Fiielld off Tellecom ((JJE
TF to JJTO TF,, AE TF to SDE TF etc)) but the IIndustriiall staffff were iignored.. A proposall has allready
been submiitted to Management through GM TF ND llyiing pendiing ffor years together..
Consiideratiion off the proposall iin consulltatiion wiith the staffff siide iis urged..
3.. Grant off Restriicted Holliiday
The IIndustriiall workers are not granted two restriicted holliidays as iin the case off non iindustriiall
emplloyees and Executiives.. IIt iis urged to extend the ffaciilliitiies to the IIndustriiall workers..
4.. Standiing Order ffor IIndustriiall Workers
A drafft Standiing Order was under consiideratiion off BSNL Management ffor a some tiime back..
That shoulld be ffiinalliized iin consulltatiion wiith the Staffff Siide wiithout any ffurther dellay..
5.. Rellaxatiion iin qualliiffyiing serviice ffor SC/ST Offffiiciialls iin promotiions under NEPP
The agreement on NEPP assured to iimpllement allll the constiitutiionall saffeguards ffor the SC/ST
emplloyees iin the promotiions under NEPP.. But the management iis not comiing fforward to
iimpllement reservatiions iin the NEPP promotiions on the ground that such reservatiions are
possiiblle onlly iin the case off post based promotiions and siince NEPP iis not a post based
promotiion scheme,, the reservatiions are not possiiblle.. We propose that even though iit iis not a
post based promotiion scheme,, rellaxatiion iin qualliiffyiing serviice iin a partiicullar scalle ffor promotiion
to next scalle be giiven to the SC/ST offffiiciialls on the ffollllowiing grounds::
a)) Earlliier,, iin the OTBP/BCR promotiion scheme the SC/ST offffiiciialls were giiven rellaxatiion iin
qualliiffyiing serviice iin case there iis shortffallll iin the number off SC/ST emplloyees among the
promoted offffiiciialls compared to 15% and 7..5% requiirement prescriibed as per the
constiitutiion..
b)) IIn the State Tradiing Corporatiion,, “One year rellaxatiion iis giiven to SC/ST emplloyees iin the
qualliiffyiing periiod off serviice at each stage off promotiion under the tiime bound promotiion

c)) The SC/ST candiidates are giiven ffiive years age rellaxatiion iin recruiitment compared to other
categoriies off emplloyees.. Thiis means iin generall,, the SC/ST emplloyees enter the serviice llate
iin theiir age compared to OC emplloyees.. IIn such case,, iiff both SC/ST emplloyees and OC
emplloyees are giiven tiime bound promotiion wiith the same periiodiiciity off qualliiffyiing serviice,,
the SC/ST emplloyees wiillll get promotiion iin theiir llate age compared to the OC emplloyees..
Thiis iis a diiscriimiinatiion whiich iis agaiinst the constiitutiionall proviisiions.. Artiiclle 38 off the
Constiitutiion diirects the State to striive to promote the wellffare off these peoplle by securiing
and protectiing as effffectiivelly as iit may a sociiall order iin whiich jjustiice,, sociiall,, economiic and
polliitiicall,, shallll iinfform allll the iinstiitutiions off the natiionall lliiffe.. Thereffore iit iis the duty off the
BSNL management,, as the part off the State,, to remove thiis diiscriimiinatiion..
Hence iit iis requested to cause orders allllowiing rellaxatiion iin qualliiffyiing serviice ffor SC/ST offffiiciialls
ffor promotiions under NEPP,, on the pattern avaiillablle iin the erstwhiille OTBP/BCR scheme and
thus honour the assurance iin the promotiionall polliicy agreement ffor iimpllementiing constiitutiionall
proviisiions..
6.. Fiilllliing up off SC/ST/OBC backllog vacanciies
IInspiite off severall ciircullars ffrom Corporate Offffiice there iis no progress iin ffiilllliing up the SC/ST/OBC
backllog vacanciies.. As per the DoPT ciircullar dated 26tth JJully 2011,, allll the avaiillablle backllog
reserved vacanciies off SCs,, STs and OBCs have to be ffiilllled up by 31--3--2012.. IIt iis requested to
iinfform the actiion taken and resullt achiieved so ffar and to take necessary actiion so that allll these
vacanciies are ffiilllled up by the target date 31--3--2012..
7.. Reservatiion iin promotiion--treatment off SC/ST candiidates promoted on theiir own
meriit--iimpllementatiion off the DoP&T Order dated 10--8--2010 retrospectiivelly wiith
effffect ffrom 2--7--1997
As per the DoP&T order dated 10tth August 2010,, the SC/ST offffiiciialls promoted on theiir own meriit and
not due to reservatiion or rellaxatiion off qualliiffiicatiions have to be adjjusted agaiinst un--reserved poiints
and not agaiinst the reserved poiints off the reservatiion roster and iit has to be iimpllemented
retrospectiivelly wiith effffect ffrom 2--7--1997,, the date on whiich the post based reservatiion was
iintroduced.. IIt iis requested to iimpllement thiis order ffulllly iin allll ciirclles,, ffor allll cadres..
8.. Cllariiffiicatiions requiired on NEPP
The ffollllowiing cllariiffiicatiions may pllease be iissued iimmediiatelly on NEPP to do jjustiice to the concerned
offffiiciialls::
ii)) The DoT recruiited offffiiciialls who got theiir promotiion/up gradatiion iin BSNL between 1--10--2000 to
1--10--2004 and got a post based promotiion affter more than 7 years affter the ffiirst promotiion/up
gradatiion are to be giiven theiir second promotiion under NEPP on complletiion off 7 years affter
theiir ffiirst promotiion.. Examplle:: A TM got BCR on 18--10--2000 and was promoted as TTA on 28--2--
2009.. The offffiiciiall has to be giiven second promotiion under NEPP on 18--10--2007 on complletiion off
7 years serviice affter the BCR promotiion whiich iis treated as hiis ffiirst promotiion under NEPP..
iiii)) Some offffiiciialls who were Sr TOA iin DoT got request transffer to another recruiitment uniit affter 1--
10--2000 iin BSNL.. For techniicall reasons,, beffore theiir relliieviing on transffer they were reverted as
TOA and affter some tiime affter theiir jjoiiniing iin the new uniit they got Sr TOA scalle agaiin.. Such
offffiiciialls were iin Sr TOA pay scalle siince 1--10--2000 to 1--10--2004 except ffor a short break periiod

CO No.. 250--74/2001--Pers--IIIIII dated 20--2--2002,, there iis no such proviisiion barriing the offffiiciiall who has
not complleted two years probatiion periiod ffrom appeariing iin the examiinatiion.. Moreover when even
the TSMs are elliigiiblle to appear iin the examiinatiion,, the JJSAs are automatiicalllly elliigiiblle iirrespectiive off
complletiion off probatiion periiod or not.. IIt iis thereffore requested to correct thiis cllariiffiicatiion so that
the JJSA iis giiven the due promotiion as TM..

ffew meetiings off the commiittee allso took pllace.. Thereaffter,, the Chaiirman off the commiittee has
stopped calllliing the meetiings.. IInfformalllly the Staffff Siide iis tolld that the Management does not want
any change iin the desiignatiions off the Non--Executiives.. IIt iis needlless to say that the Management had
agreed to change the desiignatiions off the Non--Executiives iin the fflloor off the Natiionall Counciill and
thereupon a commiittee was fformed to ffiind out new desiignatiions.. IIt iis unffaiir on the part off the
management to renege ffrom the deciisiion off the Natiionall Counciill,, to change the desiignatiions off the
Non--Executiives.. Hence,, meetiing off the Desiignatiion Commiittee may be calllled and the process off
iidentiiffyiing new desiignatiions ffor the Non--Executiives may be complleted..

through thiis exam.. However,, stiillll 135 vacanciies off Tellecom Mechaniic,, bellongiing to the 50% Diirect
Recruiitment Quota off the year 2008 are llyiing vacant..
There iis acute shortage off Tellecom Mechaniics iin H..P Tellecom Ciirclle.. Many smallll tellephone
exchanges are not properlly manned.. Beiing hiilllly area,, iit takes llot off tiime off iiff a TM iis deputed ffrom a
nearby area to attend the ffaullt.. Thereffore,, the 135 Tellecom Mechaniics posts bellongiing to the Diirect
Recruiitment Quota off the year 2008 may be converted iinto Departmentall Quota.. No ffiinanciiall
iimplliicatiion iis iinvollved iin thiis conversiion.. But iit wiillll go a biig way ffor a hiilllly ciirclle lliike Hiimachall

As per the Recruiitment Rulles off the cadre off TTA,, offffiiciialls bellongiing to the cadre off TOA,, Sr..TOA,,
Tellecom Mechaniic etc..,, shoulld possess 10+2 qualliiffiicatiion ffor appeariing the LIICE.. Among the
emplloyees off the above mentiioned cadres,, especiialllly iin the Tellecom Mechaniic cadre,, there are a
good number off offffiiciialls capablle off gettiing through the TTA LIICE,, but who do not possess 10+2
qualliiffiicatiion.. IIn the past,, two LIICEs were conducted,, one maiin LIICE and llater on a suppllementary
LIICE.. On both those occasiions,, pre qualliiffyiing screeniing tests were allso conducted.. The non 10+2
offffiiciialls who passed the pre qualliiffyiing screeniing tests were allllowed to appear the LIICE.. Thus,, a
siizeablle number off emplloyees bellongiing to the non 10+2 category have passed the LIICE iin the past..
As a resullt off thiis experiience,, the Staffff Siide has consiistentlly been demandiing that necessary
amendment to the Recruiitment Rulles off the TTA shoulld be done,, to iincorporate the proviisiion off
holldiing a pre--qualliiffyiing screeniing test ffor the non 10+2 candiidates.. The Staffff Siide has been assured
that thiis amendment woulld be done beffore holldiing the next LIICE.. Hence,, iit iis requested to make

a Pre Qualliiffyiing Screeniing Test ffor the non 10+2 offffiiciialls..

educatiionall qualliiffiicatiion iis requiired ffor the Group D emplloyees.. Thus,, no educatiionall qualliiffiicatiion iis
requiired ffor a Group D emplloyee to appear the Tellecom Mechaniic LDCE,, whereas,, a Regullar
Mazdoor iis requiired to possess 10th standard qualliiffiicatiion ffor appeariing the same examiinatiion.. Thiis
condiitiionalliity,, llaiid down by the Corporate Offffiice,, iis strange to say the lleast.. A group ‘‘D’’ emplloyee
does not know anythiing about the dutiies off the Tellecom Mechaniic.. Whereas,, a Regullar Mazdoor
perfforms allll the dutiies expected to be perfformed by a Tellecom Mechaniic and possesses compllete
knowlledge about the dutiies and responsiibiilliitiies off a Tellecom Mechaniic.. IIn the recentlly conducted
LDCE off Tellecom Mechaniic,, many RMs who do not possess 10th standard qualliiffiicatiion were not ablle
to appear.. Thiis has created unnecessary hardshiip to them.. RM and Group ‘‘D’’ cadres are consiidered
to be equiivallent cadres.. Hence,, when no educatiionall qualliiffiicatiion iis requiired ffor a Group ‘‘D’’
emplloyee to appear the Tellecom Mechaniic LDCE,, the same condiitiion shoulld applly to the Regullar
Mazdoor allso..
Nowadays,, no tellecom Mechaniic post iis beiing created,, due to the declliine iin the number off llandlliines..
Allll the remaiiniing TM vacanciies may be ffiilllled up iiff one more LDCE iis conducted.. Hence,, the RMs who
do not possess 10tth standard qualliiffiicatiion may be giiven one llast chance to appear the Tellecom
Mechaniic LDCE.. For thiis,, Necessary amendment may be made to the Tellecom Mechaniic Recruiitment
Rulles,, so that the Regullar Mazdoors need not possess 10th standard qualliiffiicatiion ffor appeariing that
exam..

                                                          Life Story of Jalaram Bapa

Shree Jalaram Bapa was born in the year 1800 AD in the village Virpur, Gujarat. His mother, Rajbai was very fond of serving sadhus and saints. No sadhu and saint could go from Virpur without receiving the hospitality of Rajbai. Shree Jalaram Bapa's father's name was Pradhan Thakkar, who was engaged in business.
At the tender age of 16, Jalaram married Virbai, daughter of Thakkar Pragji Somajia. Jalaram was however not inclined to live household life and to continue to do business with his father. He is mostly engaged in serving sadhus and saints. He separated himself from his father's business and stayed with his uncle, Valjibhai, who was very fond of Jalaram. It was obvious that Jalaram was inclined to completely withdraw from marital life. Fortunately his wife, Virbaima decided to follow the path of Jalaram. So, when Jalaram decided to go for a pilgrimage for holy places, Virbaima followed him.
At the age of 18, Jalaram Bapa accepted Shree Bhojalram from Fatehpur as guru and was given a "Guru Malaa and Mantra" in the name of Shree Ram. With blessings of his guru, he started "Sadavrat" a feeding centre, a place where all sadhus and saints as well as the needy could have food any time during 24 hours. Nobody returned from that place without having food. All this he did single handed with Virbaima assisting him.
Soon his fame spread as an incarnation of the divine. Whoever come to Virpur, whether Hindu or Muslim was fed by Bapa. Once three Arabs in the service of Thakore of Rajkot demanded an increase in wages by four rupees in a month. Being refused, the Arabs resigned and set out to Junagadh. On their way, they hunted few birds and kept them in their shoulder bag. When they reached Virpur, Bapa asked them to have their meals and then go. When they protested that they were Muslims, Bapa said that in the court of God there was no distinction in caste and creed and they were welcome.
The three Arabs had their meals in the temple but they were embarrassed that they were carrying dead birds in their bag. The Bapa touched the bag and said that the birds were feeling suffocated. The Arabs opened the bag and found that the birds were alive. They flew away to a nearby tree. The Arabs were amazed and understood that they were in the presence of divine person. They fell at his feet and asked whether they would get a job in Junagadh.
Bapa said "What was the need to have a job in Junagadh? The Arabs serve only one master." Just at that time, a camel man sent by Thakore of Rajkot arrived there. He took back the Arabs with him saying that Thakore has sanctioned an increment of seven rupees in their wages.

There are many stories about the greatness of the saint of Virpur. Remembering the stories, we can fill the heart with devotion and gratitude.

According to the National Crime Records Bureau’s latest report, 2,56,913 farmers have committed suicide in India, in the last 16 years. In Maharashtra alone, 50,000 farmers have committed suicide during this period. This is the worst ever recorded wave of suicides in human history. It is needless to say that this is the result of the Neo-Liberal Economic Policy being implemented in our country since 1991.

[29.10.2011]BSNLEU is firm on one day strike

BSNLEU is very firm that the one day strike should take place as per schedule. Earlier, the JAC unanimously decided to go on one day strike on 10-10-2011. Since NFTE expressed it’s willingness to join the strike and desired for a change in the date, the strike was deferred. Thereafter, the JAC met and unanimously decided to go on strike on 15-11-2011. However, before fixing the date, JAC Convenor telephonically consulted NFTE and they gave their consent for it. Now, NFTE has written a letter to the Convenor, JAC, stating that “one day strike will not bring the desired result”. The letter is placed on NFTE website also. Many comrades are contacting CHQ and are enquiring about this. It is NFTE’s view. As far as BSNLEU is concerned, it is very firm that the strike should take place as per the JAC decision. Comrades are requested to go ahead with the strike preparations seriously.

It is learnt that the NE-12 file is yet to be cleared by the CMD and that he has sought certain inputs on the issue. Since CMD is out of station, he could not be met today. TTA LICE : As per TTA recruitment rules only candidates with 10+2 qualification can appear the LICE. We have demanded that a qualifying screening test should be conducted for the non 10+2 candidates. A discussion on this subject has already taken place. We hope that our demand would be accepted.

Telecom Mechanic LDCE : As per the TM Recruitment Rules only RMs with 10^thstandard qualification can appear the LDCE. We have forcefully taken up that all RMs, without any qualification should be allowed to appear the Telecom Mechanic LDCE. But Management is reluctant to accept our demand. The National Convention held at New Delhi on 22^nd July, 2011, against the PFRDA (Pension Fund Regulatory and Development Authority) Bill, has decided to conduct a nation wide signature campaign against the bill. The signature campaign is to be conducted not only among the employees, but also among the general public. By passing the PFRDA bill in the parliament, the UPA government intends to privatize the system of payment of pension. The pension that our retired employees are getting is under serious threat. Hence, all the circle and district secretaries are requested to attach utmost importance to this job of collection of signatures. On Thursday the Supreme Court questioned as to why the Government allowed A. Raja to follow the first come first served policy. The Supreme Court pointed out that On 2^ndNovember, 2007, Prime Minister Manmohan Singh wrote a letter to the then Telecom Minister A.Raja, suggesting to follow a transparent methodology of auction for spectrum allocation. The Bench consisting of Justices G.S.Singhvi and H.L.Dattu further observed that the whole scam could have been prevented had timely action been taken by the government, instead of allowing A. Raja to follow the first come first served policy.

The report of the Anomaly Committee, that was constituted to settle the anomaly that arose in the 2002 wage revision, was not implemented fully. This issue was taken up in the last National Council. Management Side told that this situation arose because of the misunderstanding that has taken place due to some of the wordings in the report. In the discussion that took place in continuation of this, it was decided that the same Committee on anomalies will again meet and do necessary corrections to the wordings of the earlier report. Accordingly, the meeting of the Anomalies Committee is taking place on 17.10.2011. Com.V.A.N.Namboodiri, President and Com. P.Asokababu, Dy.GS are the Staff Side members of the Committee. We hope that the problem will be solved once for all in this meeting.

After judgment is delivered by the Hon’ble CAT of the Ernakulam Bench, in the JTO LICE case, BSNL had filed an affidavit seeking a clarification. The clarification sought was that whether the reduction in the qualifying service from 10 years to 7 years is to be implemented retrospectively or prospectively. CHQ has been following up this case continuously for an early disposal. Now it is learnt that the hearing of the case is over and that the verdict is reserved. We hope that the verdict will come out soon and that the LICE would be held expeditiously.

The partial implementation of the anomaly committee report (Relating to the wage revision of 2002) was raised in the last National Council. It was replied that the needful would be done to implement the recommendations fully. GS, BSNLEU discussed the issue with GM (Estt.) on 03.10.2011. It was agreed that one more sitting of the anomaly committee would take place soon, to clear the ambiguity found in the report, so that the recommendations can be fully implemented.

The JTO LICE is being unduly delayed. The petition filed by BSNL, seeking clarification on the judgement of the Hon’ble CAT of Ernakulam has not received any reply. On 03.10.2011, GS, BSNLEU met the GM (Estt.) and expressed his concern over the undue delay in holding the JTO LICE. GM (Estt.) assured to take all expeditious measures to get early clarification from the Hon’ble CAT, so that the LICE could be held.

[20.09.2011]Meeting with Management on VRS

BSNLEU was invited by the management today, the 20-09-2011, for a discussion on VRS. Director (HR) and other senior officers took part in the discussion. Management gave a presentation on their proposed VRS scheme. In the discussion that took place after the presentation, leaders of BSNLEU firmly told the management that they oppose VRS of any type. They also pointed out that VRS scheme is absolutely not necessary to pull out BSNL from the present crises. Management was also told as to how the condition of MTNL did not improve even after implementing VRS three times. Our opposition to VRS will also be conveyed to the management through a letter. Com. It appears that some confusion is created in respect of working hours, due to the clarification issued by Corporate Office yesterday, vide letter no.14-1/2011-TE dated 13.09.2011. There is nothing new in this clarification. It is only a consolidation of the already existing rulings. According to this clarification, there will not be any change in the present pattern of working hours in BSNL Offices.

Director (ED) assured that that the production of the pipes would not be stopped.

[09.09.2011]Supreme Court order on reservation- a set back for the reserved category employees.

The Hon’ble Supreme Court of India has delivered a judgment on 08-09-2011, on the issue of reservation. The Hon’ble Court has held that reservation rules will not apply, where a candidate gets only higher pay scale, but continues to hold the same post without any change in duties and responsibilities. This judgment was delivered by a bench consisting of justices R.V.Raveendran and Markandey Katju. This judgment is a set back for the employees belonging to the reserved categories.

[09.09.2011]BSNL CO clarification on NEPP- a set back for the TSMs regularized on or after 01-10-2000.

BSNL CO has issued a clarification on NEPP, wherein it is stated that the TSMs regularized on or after 01-10-2000, will be treated only as BSNL recruitees , as far as NEPP is concerned. This clarification is based on a reply given by the DOT on the matter. BSNLEU has demanded that these employees, numbering around 15,000, should be treated as DOT recruitees, since they are already issued with Presidential Orders. CHQ will not accept this arbitrary order of the BSNL and will find ways and means to get justice for these employees. <>

The JAC, in it’s meeting held on 07.09.2011, vehemently opposed the curtailment of medical allowance, LTC and Leave Encashment, and called upon the BSNL employees to hold massive dharnas throughout the country on 14^th September, 2011. Circle and District Secretaries are requested to immediately arrange to hold meetings of the JAC at all places and plan to organise the dharna massively. The dharnas to be held on 14^th September shall be a befitting reply to the high-handeness of the management.

[21.09.2011]JAC decides to observe one day mass fast on 27-09-2011 and one day strike on 10-10-2011.

The JAC which met at New Delhi today 21-09-2011, took the historic decision to oppose the VRS, lock stock and barrel. The meeting which was presided over by com.G.L.Jogi,GS,SNEA, unanimously decided to observe one day mass fast at All India level, circle level and SSA level on 27-09-2011 and to go on one day strike on 10-10-2011, opposing VRS, demanding PLI, etc

The unions which participated in today’s meeting are BSNLEU, SNEA, AIBSNLEA, BSNL MS, TEPU, SEWA BSNL, BTU and NFTBE.

PROGRAMME

Mass fast at All India, circle and SSA levels on 27-09-2011.

One day strike on 10-10-2011.

DEMANDS

1) No VRS.

2) Payment of PLI.

3) Restoration of medical allowance, LTC and Leave encashment.

4) Policy related issues

5) Conclusion of the process of absorption of ITS.

6) Merger of 78.2% IDA.

Policy related issues include:-

a) Compensation for BSNL’s rural operations.

b) Pension contribution on actual basic pay.

c) Refund of RS.8313 crore to BSNL which was paid towards BWA spectrum charges.

d) Reimbursement of License Fee.

e) Allowing BSNL to surrender 3G spectrum of unviable circles.( Private companies are given the freedom to select circles of their choice.)

f) Refund of Rs.7500 crore with interest, collected from BSNL towards “Notional Loan.”

g) Procurement of equipments.

h) Discontinue TACs.

It is decided to approach NFTE and FNTO also for united action.

Organise the programme very effectively, inorder to give a fitting reply to the retrograde steps being taken by the government and the BSNL management, to destabilize BSNL.

[20.09.2011]Meeting with Management on VRS

BSNLEU was invited by the management today, the 20-09-2011, for a discussion on VRS. Director (HR) and other senior officers took part in the discussion. Management gave a presentation on their proposed VRS scheme. In the discussion that took place after the presentation, leaders of BSNLEU firmly told the management that they oppose VRS of any type. They also pointed out that VRS scheme is absolutely not necessary to pull out BSNL from the present crises. Management was also told as to how the condition of MTNL did not improve even after implementing VRS three times. Our opposition to VRS will also be conveyed to the management through a letter. Com. VAN. Namboodiri, Presisdent, Com. P. Abhimanyu, GS, Com. P Asokababu Dy.GS and Com. G.B. Salakki, AGS took part in the discussion.

VOLUNTARY RETIREMENT SCHEME (VRS)

2. DPE/Guidelines/VIII/2

Voluntary Retirement Scheme/Voluntary Separation Scheme for the employees of Public Enterprises.

The parameters on the basis of which the VRS could be formulated by the PSUs for their employees have been spelt out in this Department’s OM of even number dated 5.5.2000. However, there are

certain points on which clarifications have been solicited by the PSEs as well as the administrative Ministries/Departments. These points have been examined in the Government. The points as well as the clarifications are given here under:-

1. Whether allowances like Personal Pay, HRA, NPA, Family Planning increment are to be included for computation of ex-gratia?

Basic pay plus DA only is to be taken into account for computation of ex-gratia under VRS.

2. Whether the post of the employee who has taken VRS is to be abolished?

There shall be no recruitment against vacancies arising out of VRS.

3. Whether any arrears of ex-gratia are to be paid in the event of pay revision being sanctioned subsequent to voluntary separation?

Ex-gratia will be re-calculated on the basis of revised pay scale and the difference be paid.

4. Can notice pay in lieu of notice and TA for settling in the Home Town or elsewhere be paid to the employees who are to opt or have opted for VRS?

One month/three months notice pay (as per service conditions applicable to the employees) may be paid. TA for the employees and family would also be admissible to the place where he intends to settle down after taking VRS. For this purpose, the entitlement will include transportation cost of personal effects and travelling cost of self and family members, as admissible under the entitled classes.

5. Under the Gujarat pattern, will the compensation for the balance service be calculated @ 25 days for every year of service left?

Compensation under VRS modelled on the Gujarat pattern will consist of salary of 35 days for every year of service completed and 25 days for every year of service left until superannuation.

6. Under VSS, will the employee be entitled for 60 months salary even if he has not completed 30 years of service?

No.

7. 60 months salary as ex-gratia is permissible under VSS scheme of Department of Heavy Industry. If the VSS scheme is modelled on Gujarat pattern (para 5 of O.M. dated 5.5.2000), will the employee be still entitled for 60 months salary if he has completed 30 years or more service?

Sixty months salary as compensation is attached to VSS package of the Department of Heavy Industry only and not under the Gujarat model.

8. Whether PF, leave encashment, gratuity, notice pay, LTC are payable to employees in case of voluntary retirement?

These are to be paid to the employees opting for VRS as per the provisions of the relevant statutes and the service conditions. These are outside the computation of ex-gratia on voluntary retirement.

9. Is any minimum qualifying service necessary for opting for VRS?

No age bar or minimum qualifying service is prescribed.

10. Do the companies have the choice to opt for either the Gujarat model or VSS on DHI model for the sick and unviable units?

The Boards of the sick and unviable PSUs are obliged to offer VSS on DHI pattern to the employees. The Board have the option to offer, in addition, VRS on Gujarat pattern, in which event the employees will have a choice between the two schemes.

11. The managements have the right to reject the VR application of certain employees as they have to ensure that the company is not denuded of talents. In that case, what would be the treatment given to such employees who have been retained by the management in case the PSU is closed. Will they be offered VSS in case the PSU is closed. Will they be offered VSS even after a lapse of three months or will they be paid retrenchment compensation under ID Act?

The cases of such employees will be covered under he final settlement on closure of the unit. If the benefit of VSS is extended on closure, such employees will also receive it.

12. Whether Casual Leave may be encahsed up to he date of notification of VRS or actual date of relief of employee?

CL may be encahsed on pro-rata basis up to the date of relief of employee.

13. What would be the compensation payable in case where the balance of service left under superannuaion is less than 250 days and sum of the salary for the balance period is less than Rs. 25000/-.

The computation is explained in the enclosure.

14. Whether he notice period pay is to be paid in addition to 60 months salary as compensation in case an employee has completed 30 years of service and the remaining period of service is 75 months.

If the application of an employee for voluntary retirement is accepted instanteously and payment is arranged by the management on the same day, the concerned individual would be entitled to payment of ex-gratia along with the notice period pay. It is, however, clarified that payment of ex-gratia for service rendered or left over service before superannuation as well as the amount payable for the notice period should not exceed the basic pay plus DA that would have been paid to the employee who has opted for voluntary retirement till the date of his superannuation. For example, if an employee opts for voluntary retirement a few months before the date of superannuation, say at 57 years and 10 months, the payment should be restricted to 2 months basic pay plus Dearness Allowance.

In circumstances where the management takes time to take a decision about the acceptance of an application submitted by the employee for voluntary retirement and allows the notice period to lapse or the individual concerned has drawn full salary during the notice period served by him, in these cases notice period pay would not be admissible as the individual has already drawn the salary during the notice period.

15. Whether it is mandatory to introduce new VR Scheme or continue with the existing scheme?

The new scheme has been introduced in supersession of the old scheme.

16. If the VRS is implemented in the middle of any particular month, whether full months salary is to be computed for VRS purpose?

An employee is entitled to payment of salary till the date of voluntary retirement, regardless of the date of implementation of the VRS. As for computing the completed years and months of service for the purpose of ex-gratia, the datum will be the date on which the employee in question had joined service.

17. If the employee has completed 20 years and 9 months service whether he will be paid compensation for 20 years service or compensation for 20 years of service plus proportionate days salary for the nine months service also?

The calculation would have to be based on every completed year of service or part thereof. The part of the complete year served shall be entitled for ex-gratia on pro rata basis.

18. Whether service rendered in other PSEs would be taken into account for purpose of computation of VRS from the latter employing organization?

This would be taken into account only on transfer of cash equivalent of Earned Leave and Provident Fund. Gratuity would be as per the provisions of the Act.

19. Will notional pay revision from 1992 and 1997 be taken for computation of VRS/VSS benefits?

In the new VRS/VSS scheme, there is no scope for computation of the ex-gratia on notional salary revision.

20. Will encashment of sick leave at the time of taking VRS/VSS be permissible?

Encashment of sick leave has nothing to do with VRS/VSS. Its encashment will depend on the management decision, based on the service conditions.

21. Will the casual workers be included for the purpose of VRS/VSS who have completed more than 20 years of service?

Casual workers will not be entitled for VRS/VSS. Refer to para 9 of O.M. dated 5.5.2000.

22. Whether the contract employees appointed on contract basis can be considered as temporary employees for purposes of VRS? If yes, how the compensations would be calculated?

Contract employees are outside the purview of VRS.

23. How would the computation of ex-gratia (VRS) under Gujarat pattern be done?

As per enclosure.

VRS COMPENSATION UNDER GUJARAT PATTERN

Computation of one Day’s Salary in Gujarat Pattern

Basic + DA

Rs. 7000 + Rs. 2500 = Rs. 9500

Rs. 9500 26 days = Rs. 365.38 (one day’s salary)

Completed 32 years service.

32 Yrs. X 35 days X Rs. 365.38 = Rs. 409225.60

NOTE: (i) for computation of one day’s salary 26 days a month is taken.

Remaining 3 years service:

3 years X 25 X Rs. 365.38 = Rs. 27403.50

Total amount payable: Rs. 409225.60 + Rs. 27403.50 = Rs. 436629.10

Total amount to be paid as VRS compensation: 36 X Rs. 9500 = Rs. 342000/-

NOTE: The payable amount would have to be restricted to Rs. 3,42,000/-.

NEW DELHI: Telecom Commission, the decision making arm of the Department of Telecom, today cleared the Rs 20,000-crore project to provide broadband connectivity to all villages in the next three years.

"The Telecom Commission has approved the project that will be funded through the Universal Service Obligation (USO) Fund. We will take the proposal to the Cabinet soon," Telecom Minister Kapil SIbal told reporters here.

The objective of the scheme -- National Optical Fibre Network -- is to extend initially the existing optical fibre network which extends up to districts Head Quarters/Block Head Quarter level up to gram panchayat level by utilising USO Fund.

"The cost of the initial phase of the scheme is likely to be in the region of Rs 20,000 crore. Similar amount of investment is likely to be made by private sector complementing the infrastructure while providing services to individual users," he said.

The broadband project will initially be executed by state owned Bharat Sanchar Nigam Limited (BSNL) and other institutions like RailTel, he said.

"If necessary, at a later stage, we will involve the private sector also to ensure that the project is completed within the stipulated period of three years," Sibal said, adding that this would help in brining in e-education, e-medicine and e-governance.

As per a study conducted by the World Bank, with every 10 per cent increase in broadband penetration, there will be an increase in GDP growth by 1.4 per cent, Sibal said.

"This is a historic step... we will take it to Cabinet and complete the project within three years," he added.

Asked about the USO Fund's corpus, Telecom Secretary R Chandrashekhar said the current corpus is about Rs 15,000 crore and it gets up to Rs 6,000 crore in its kitty every year from the operators.

He also clarified that no other project relating to voice telephony under USO Fund would be sacrificed due to National Optical Fibre Network scheme.
