Sub:-BSNL non-executives Promotion policy agreement- request for approval of
9200-250-13200 payscale - reg
With reference to the above mentioned subject, we submit the following for your kind
consideration:
1. After three and half years of discussion, the BSNL management signed an agreement
with the recognized union of BSNL non-executives i.e BSNL Employees Union, on 30-
10-2008 on the issue of promotion policy for non-executives as per which the nonexecutives
are to be given time bound upgradation to the next higher scale on
completion of 8 years service in BSNL in a particular IDA pay scale. Maximum 4
promotions are to be given in BSNL as per this agreement. (In this connection it is
submitted that the BSNL management favored the executives with five time bound
upgradations in BSNL at the rate of one upgradation for every five years).
2. The non-executives are having 11 pay scales, from NE-1 to NE-11. To facilitate next
upgradation with in the purview of these four upgradations, to those who are in the NE-
11 pay scale, a new pay scale 9200-250-13200(NE-12) was included in this agreement.
3. This agreement was sent by the BSNL management for the approval of DoT and DoT in
turn wrote to BSNL management stating that as per the Articles of Association the BSNL
Board was having the power to decide about the promotion policy agreement. But
instead of approving and implementing the promotion policy agreement, the BSNL
management sought for the approval of the newly formulated NE-12 pay scale(9200-
250-13200) from DoT on the plea that without such approval, the CCAs(Controllers of
Communications Accounts) might object for payment of pension for those who would
retire in that pay scale.
4. It is understood that the authorities in DoT are raising an objection regarding this NE-12
pay scale that it is coming into conflict with the E-0 scale prescribed by DPE and such a
conflict is not allowed as per DPE guidelines. In this connection the following facts are
submitted for your kind consideration:
(a) In BSNL, there are no E0 and E1 pay scales for the executives. The Executives
pay scales are starting with E1A (9850-250-14600). The proposed
pay scale NE-12(9200-250-13200) is therefore not in conflict with any of the executives’
pay scales in BSNL.
(b) It is understood that as per the DoT authorities, the maximum of this NE-
11(8570-245-12245) is already more than the maximum of the standard E0 pay
scale (6550-200-11350) prescribed by DPE and hence it is already in conflict with
DPE prescribed executives’ pay scales and an additional pay scale NE-12 conflicting
with this executive pay scale is against DPE guidelines. In this connection it is to be
noted that the highest recruitment pay scale for non-executives in BSNL is only NE-
9(7100-200-10100) and the NE-10 and NE-11 are merely for facilitating time bound
promotions on completion of 16/26 years service and more in the same cadre, as per
the earlier DoT orders.
(c) In the CDA pay scale which were in operation prior to 1-10-2000 when the BSNL
absorbed employees were DoT employees, the equivalent of the NE-11(8570-245-
12245) was 6500-200-10500 and the pay scale of JTO(the lowest level executive in
BSNL) at that time was equal to this pay scale. With the idea that the pay scale of
non-executive should be less than the pay scale of executives, the BSNL
management created the equivalent of this pay scale as 8570-245-12245 for nonexecutives
and 9850-250-14600 for executives. This being the historical background,
the NE-12 pay scale created for the purpose of time bound promotion for the nonexecutives
will naturally be higher than this 8570-245-12245 pay scale. Therefore
when viewed in this background, the 9200-250-13200 pay scale is fully justified.
2. In view of the fact that this NE-12 pay scale is less than the lowest executive pay scale
E1A in BSNL and in view of the above said historical back ground and relativities, it is
requested to kindly cause necessary action for approval of this 9200-250-13200 pay
scale and help in the immediate implementation of the BSNL non-executives promotion
policy which remains unimplemented even one year after signing it.

[30.10.2009]Pay Anomaly Committee meeting:- The Pay Anomaly Committee meeting was held on 30-10-2009. Com V.A.N.Namboodiri GS and Com P.Asokababu AGS BSNLEU participated from the Staff side.

The necessity to form another Committee arose since the DoT rejected the agreement of the earlier Anomaly Committee. It stated that Revised Pay Rules and option for pay fixation from the date of next increment falling after 1-10-2000 for those promoted before 1-10-2000 are not applicable for settling the anomaly cases. As such the management stated that it is almost impossible to settle the issues. Management also pointed out that neither in MTNL nor for executives in BSNL it self such anomalies/aberrations could be settled.

The staff side pointed out that at the time of conversion of CDA pay scales to IDA pay scales itself it was assured by the management that these anomalies/aberrations will be sympathetically considered and settled. In the wage revision order (CDA to IDA) also it was mentioned. As such the management has to take suitable decision for early settlement.

After much discussion the official side was prepared to consider the issue of granting personal pay to the extent of the difference to the seniors after promotion of the junior to the higher grade. It will also be considered whether the senior in the higher grade can be given personal pay to the extent of difference between senior in the higher grade and junior in the lower grade.

[30.10.2009]Meeting of United Forum:- The meeting of United Forum held on 29th October, 2009 at National Council room discussed reservation / relaxation in promotion policy and entrusted a committee consisting Coms. B.R. Jakhatia, V. Subburaman, P. Asokababu and Babu Singh to prepare a document in full justification of our claim to be put before management.

The meeting also decided to demand the management to hold the meeting of Wage Negotiation Committee urgently and settle wage revision.

[26.10.2009]Meeting with CMD: - Com. V.A.N. Namboodiri, General Secretary, BSNLEU along with Coms. P. Asoka Babu, AGS, K.R. Yadav, Vice-President and Animesh Mitra, Circle Secretary, West Bengal met Shri Kuldeep Goyal, CMD on 26th October, 2009 and discussed the following issues.

Meeting with BCG: - Com. V.A.N. Namboodiri, General Secretary, BSNLEU along with Coms. P. Asoka Babu, AGS, K.R. Yadav, Vice-President and Animesh Mitra, Circle Secretary, West Bengal met the Boston Consultancy Group (BCG) as per their invitation. The BCG Group along with Smt. Madhu Arora, GM, (Restrg). explained the projects being implemented like Kuber, Shikhar, Udam etc. We gave our opinions / Suggestions.

Wage Negotiation: - General Secretary met BSNL officers and demanded to fix the next meeting early. It is expected that the meeting will be fixed this week itself.

[19.10.2009]National Co-ordination Committee of Pensioners' Associations (NCCPA - Secretary General Com. S.K. Vyas) called for Dharna at SSA Offices of BSNL throughout the country from 27th to 29th October, 2009 demanding 50% IDA Merger, Revision of Pension of BSNL Retirees etc. BSNLEU (CHQ) calls upon all Circle, District and Branch Secretaries to extend all help, support and solidarity and to participate in the programme. [13.10.2009]Brief of the wage negotiation meeting on 13th October 2009.

After detailed discussion in the wage negotiation meeting today ,13th October 2009, the management proposed the following:

1. 30% fitment with 10 year periodicity with 68.8% IDA for the present and raising to 78.2% with executives

2. If period of wage revision is reduced to executives, it will be done for non-executives also.

3. There can be a review after 5 years.

The Unions demanded review after 5 years without mentioning the periodicity.

The next meeting will take place after Diwali.

[12.10.2009]Presidential orders in respect of TSMs regularized after 01.10.2000 issued:- After the issue was taken by BSNLEU in the DoT-BSNL-BSNLEU Committee the Presidential orders for all circles other than mentioned below have been approved by DoT and sent to BSNL. [09.10.2009]GS BSNLEU meets Member (Finance), DoT:- Com. V.A.N. Namboodiri, General Secretary, BSNLEU met Shri Vijayalakshmi K. Gupta, Member (Finance) DoT on 09.10.2009 and discussed the issue of approval of the Rs.9200 payscale newly introduced in the Promotional Policy. Member (Finance), DoT assured that the approval will be given early, without any delay.

[07.10.2009]Joint Forum Meeting on 7th October 2009:- The meeting of the executive and non-executive Associations / Unions held on 7th October, 2009 at National Council Room, Eastern Court, New Delhi after thorough discussion, took the following decisions:

Demand the management to ensure implementation of the assurance given to the Joint Forum that the ITS absorption will be finalized before December 2009.
Demand the DOT to rescind the orders issued regarding deputation of Account Officers from DOT.
Meet the CMD to find out about the various reports coming in the press regarding outsourcing, forming of another company from BSNL, sharing of infrastructure etc. since no official statement has come so far. After meeting the CMD, Joint Forum will meet and plan our strategy and action programme.
Consult BCG report with the Unions before implementing the same.
Next meeting of the JF will be held after meeting CMD.

[07.10.2009]Meeting with Director (HRD):- Com. V.A.N.Namboodiri, GS, BSNLEU along with Coms. R.S.Chauhan, Org. Secretary and Lalan Sah (corporate office) met Shri Gopal Das, Director(HRD) and discussed the following issues:

Wage Revision: The Union insisted that the wage revision be finalized early. Director (HRD) stated that the issue be discussed in the meeting on 13th October 2009.
Promotion Policy: Director (HRD) agreed to contact with DOT for the early clearance of the 9200- pay scale for which it was referred to DOT. The Policy will be implemented as soon as it is received back.
3. Director (HRD) assured for holding the National Council early.

[06.10.2009]SSA March and Bharat Sanchar Bhawan March: - Mysore Central Executive Committee has decided to organize SSA March and Bharat Sanchar Bhawan March, if the Wage Revision, Promotion Policy etc. are not settled with out further delay. Meet each and every worker, explain the unhelpful attitude of management and prepare for organizing the above programmes.

[06.10.2009] GS Meets Secretary, DoT: - Com. V.A.N. Namboodiri, General Secretary, BSNLEU met the newly appointed Chairman, Telecom Commission & Secretary, DoT, Shri P.J. Thomas on 5th October, 2009 and welcomed and greeted him. It was a curtsey call.

[06.10.2009] HLL Workers reject 10 year periodicity:- Hindustan Latex Limited management offered 30% fitment on basic, 21% personal pay and 3% extra for 10 year period. The union has rejected the offer since it is for 10 year period. They want 5 year periodicity.

Relief on the line for telecom companies

NEW DELHI: TOP telecom players such as Bharti Airtel, Vodafone Essar, Reliance Communications and state-owned BSNL could benefit from a government move to speed up a relief package that will ease some burden off the sector saddled with shrinking revenues and margins triggered by a raging tariff war.

The department of telecom (DoT) will seek a fast-track approval from the finance ministry to slash the annual licence fee by up to a third for telecom operators with large network presence. It will also propose to the finance ministry that all licence fee be exempted for landline services, a top official in the communications ministry told ET.

The licence fee cut will benefit the four top operators the most, since their networks cover all census towns and large villages in several states.

Also on the anvil is a plan to speed up the introduction of a single-levy structure, after sector regulator Trai gives its recommendations on this subject next month. At present, telecom operators pay up to 30% of their revenues towards different levies to the government.

Along with these measures, the communications ministry is also working with the finance ministry to release up to Rs 16,000 crore from the Universal Service Obligation Fund in the next 24 months to subsidise both private and state-owned operators’ expansion to rural and far-flung areas.

All telecom operators have been paying 5% of their annual revenues towards this fund since 2002, taking the kitty to Rs 20,000 crore, which has been lying idle. Every consumer, who makes a phone call (mobile and landline), contributes towards the fund.

Earlier this year, the government had shelved its decision to slash the licence fee for telecom operators with large network presence by up to a third from April 1, following opposition from the finance ministry.
After this, the communications ministry had informed all telcos that the “licence fee cut has been kept in abeyance”.

Telecom minister A Raja will now seek fresh clearance from the finance ministry on the issue, as this proposal will help the industry save up to Rs 2,000 crore annually, the communications ministry official added.

Last year, DoT had announced that the proportion of the revenues telecom operators pay as licence fee to the government would be cut by 2% of their total revenues if they prove that their services are available in 95% of the residential areas in a state or a telecom circle, with effect from April 1, 2009.

At present, telcos pay 10% of their revenues as licence fee in category ‘A’ circles (Tamil Nadu and Maharashtra, among others) 8% in ‘B’ zones (Kerala, Punjab and Haryana, among others) and 6% for ‘C’ circles (Himachal Pradesh, Bihar and Orissa, among others).

As per last year’s announcement, these would have come down to 8%, 6% and 4% for operators with networks covering over 95% of the residential areas in a circle, but the proposal was never implemented as the DoT could not obtain Cabinet clearance for the same due to opposition from the finance ministry.

Similarly, the finance ministry’s objections also resulted in the DoT failing to implement its decision to exempt licence fee for fixed-line telephony in rural India from January 2009 onwards. Had this proposal been implemented, BSNL would have been the largest beneficiary, as the PSU would have saved up to Rs 1,200 crore annually.

The DoT is now working on a modified proposal under which licence fee will be exempted for all fixed-line services. Mr Raja discussed this proposal that will offer incentives to fixed-line operators during his meeting with top telecom industry executives in Delhi on Tuesday, a CEO of a mobile operator told ET.

While the fixed-line operations of private players are largely restricted to metros and large cities, the move will enable the industry to save about over Rs 1,600 crore in levies annually, another industry executive aware of the development told ET.

Sub: Authorization to all SDEs/JTOs I/C of Exchanges/BTSs to lay OF Cable & UG Cable by
engaging LOCAL LABORS.
In order to expedite the provisioning of OFC Media to Phase V BTS sites, it has been
decided as under pl;
a) For all OF Cable laying works (Laying of HDPE Pipes) of length less than or equal to
500mtrs, all SDEs/JTOs are empowered to engage LOCAL LABORS from city/town/village
for making of trench, laying of HDPE pipes with protection pipes if required, refilling of
trench, making of joint pit etc.
b) Similarly for all UG Cable laying works of length less than or equal to 500mtrs, all SDEs/JTOs
are empowered to engage LOCAL LABORS from city/town/village for making of trench,
laying of UG Cable with protection if required, refilling of trench, making of joint pit etc.
However UG Cable under these orders should be laid only in those areas where immediate
demand of Landline & Broadband is available so that UG Cable is put to use immediately
after it is laid.
c) Payments to LOCAL LABORS, engaged for the purpose (given under S.No. a & b above)
shall be made by SDE/JTO concerned on ACG-17 after obtaining suitable temporary advance
for this purpose. One advance can be taken for more than one route and its account should
be closed with the completion of those routes. These temporary advances shall be approved
by DE concerned only.
Following guidelines/procedure may be adopted in all SSAs to ensure that above
instructions fulfill the purpose for which these have been issued;
1) All SSA heads should ensure that all concerned SDEs/JTOs are suitably briefed about the
construction practices of OF Cable before they implement these orders.
2) Obtaining of the local municipal permissions shall be the responsibility of the SDE
concerned.
3) The executives, who are delegated these powers, may ensure that no individual labor is
engaged for more than 30 days at a time and not more than 100 days in a year in split
engagement.
4) If multiple such sites (of length upto 500mtrs, for OF Cable & UG Cable) exist in the
jurisdiction of concerned SDE/JTO then he/she should ensure that work is taken-up
simultaneously in all the sites by engaging LOCAL LABORS so that work is commenced and
completed in parallel. This by default shall ensure compliance of directive given under S.No.
3 above. It is known from our past experiences that a team of 10-15 LOCAL LABORS shall
generally take approximately 10 days, depending on the soil, to complete 500mtrs OFC work.
Time required for UG Cable shall be even less due to lesser trench depth requirement.
5) The executive concerned shall prepare and attach following with the ACE-2 account (and
will also maintain one copy in his office records);
i. Route Index Diagram of the OF/UG Cable laid.
ii. Total expenditure incurred route-wise.
iii. Brief on the nature of soil encountered while executing the work.
6) For the acceptance testing, the SSA heads are authorized to nominate other SDEs

Bharat Sanchar Nigam Limited (BSNL) launched its first prepaid broadband internet services in the country here on Friday.

The service, now available for subscribers in the Karnataka circle, will be extended to other circles by the end of the year. High speed internet access (24 Mbps) using very high speed digital subscriber lines (VDSL) was also launched on the occasion.
Speaking on the occasion, Chairman and Managing Director of BSNL, Kuldeep Goyal, lamented that the targets set for broadband penetration have not been met in the country. “We had a target of 10 million connections for 2007, twenty million for 2010 and 40 million for 2012. There is a huge gap to reach the target,” he said.
P Raghavan, Chief General Manager, Karnataka Telecom Circle, disclosed that there are 4.3 million BSNL broadband connections all over the country with the Karnataka Circle alone accounting for 4.8 lakh connections. The BSNL broadband services were launched on 14th February, 2005 from Bangalore.
M N Vidyashankar, Principal Secretary, Department of E-commerce said that each of 5,700 Gram Panchayats in the State would be provided with broadband connectivity by the year 2010.
A prerequisite for customers interested in subscribing to prepaid broadband services is a BSNL landline connection. Four types of vouchers of different denominations which offer unlimited download at speeds ranging from 256 Kbps to 2 Mbps are available. Nine types of vouchers of different denominations which offer limited download at speed up to 2 Mbps within the validity period of the voucher are also available.
Advantages of prepaid broadband over postpaid are: There are no fixed monthly charges; customers can use their prepaid account in any city in the country (except Delhi and Mumbai) on most of the broadband-enabled connections; existing postpaid customer can subscribe to additional prepaid connection to get the advantage of mobility. Recharge of voucher can be done anywhere in the country.
A customer has to register on the portal www.bangaloretelecom.com for Bangalore and www.karnataka.bsnl.co.in for Karnataka. Or sms ‘PPB’ to 9448077777 or send an sms via landline by typing “PPB to 9448077777 or approach any BSNL Customer Service Centre.
Initially, the customer will be given an account with user name and password with 50 MB free download and 15-day validity period. Before its expiry, recharge coupons need to be purchased.

3G in B’lore in November

The much delayed 3G services will be launched in Bangalore in November, P Raghavan, Chief General Manager of BSNL said.

Speaking to reporters onFriday, Raghavan said, “After the launch in the City, we will extend it to the entire State by March.” He said that the BSNL has plans to add 2,100 mobile towers to the existing 3,000 towers.

Meeting with Chairman Wage Negotiation Committee

The leaders met the chairman, Wage Negotiation Committee and pointed out the delay in holding the meeting of the committee. They insisted to hold the meeting this week itself, preferably on 06-11-2009. The Chairman assured to try to hold the meeting as requested by the union.

Meeting with DDG (Estt.) and DDG (FPB), DOT

The leaders met Shri. A.K.Das, DDG(Estt.), DOT, and demanded early approval of the DOT for the 9200 scale (NE 12), included in the Non- Executive Promotion Policy. They also met DDG (FPB) and discussed. In the discussions, the officers told that DOT has still not decided the case, since the 9200 scale is in conflict with the Executive pay scales. They explained that as per DPE orders, Non- Executive pay scales cannot be more than that of the Executive pay scale.

The leaders explained the DOT officers that BSNL Non – Executives are already getting 8570 scale, which is more than the E0 scale (6550) of the Executives. Further, they explained that in BSNL, the lowest Executives pay scale in operation is 9850 and that the proposed 9200 scale for the Non – Executives is lesser than that pay scale. Com. V.A.N. Namboodiri, GS, has sought a meeting with Member (Finance) and with the Additional Secretary, DOT in this matter.

Meeting with Director (HRD)
The leaders met the Director (HRD) and insisted for an early settlement of the Wage Revision issue. They also discussed with him certain aspects of the wage revision, such as periodicity, 78.2% merger of IDA, review after 5 years etc.

The leaders also requested the Director (HRD) to immediately issue order for holding
Pre -qualifying test for TTA Exam, as already agreed in the National Council meeting.

[30.10.2009]Pay Anomaly Committee meeting:- The Pay Anomaly Committee meeting was held on 30-10-2009. Com V.A.N.Namboodiri GS and Com P.Asokababu AGS BSNLEU participated from the Staff side.

The necessity to form another Committee arose since the DoT rejected the agreement of the earlier Anomaly Committee. It stated that Revised Pay Rules and option for pay fixation from the date of next increment falling after 1-10-2000 for those promoted before 1-10-2000 are not applicable for settling the anomaly cases. As such the management stated that it is almost impossible to settle the issues. Management also pointed out that neither in MTNL nor for executives in BSNL it self such anomalies/aberrations could be settled.

The staff side pointed out that at the time of conversion of CDA pay scales to IDA pay scales itself it was assured by the management that these anomalies/aberrations will be sympathetically considered and settled. In the wage revision order (CDA to IDA) also it was mentioned. As such the management has to take suitable decision for early settlement.

After much discussion the official side was prepared to consider the issue of granting personal pay to the extent of the difference to the seniors after promotion of the junior to the higher grade. It will also be considered whether the senior in the higher grade can be given personal pay to the extent of difference between senior in the higher grade and junior in the lower grade.

The next meeting will be held after two weeks.

[30.10.2009]Meeting of United Forum:- The meeting of United Forum held on 29th October, 2009 at National Council room discussed reservation / relaxation in promotion policy and entrusted a committee consisting Coms. B.R. Jakhatia, V. Subburaman, P. Asokababu and Babu Singh to prepare a document in full justification of our claim to be put before management.

The meeting also decided to demand the management to hold the meeting of Wage Negotiation Committee urgently and settle wage revision.

[26.10.2009]Telecom Factories issues discussed with BSNL Management:- Com. V.A.N. Namboodiri, General Secretary, BSNLEU along with Com. S.D. Chaudhary, All India Vice-President met Shri S.P. Talwar, Executive Director (NB) and discussed the following issues. Shri R.P. Nigam, GM (TF) was also present.

Restructure of TF Cadres
Grant of 2 Restricted Holidays to Industrial Workers ending discrimination
Pay scale of Chemists & Planners
Production & Marketing of Tower, Sim Card etc.
Shri Talwar, Executive Director assured sympathetic consideration of the issues raised.

[26.10.2009]Meeting with CMD: - Com. V.A.N. Namboodiri, General Secretary, BSNLEU along with Coms. P. Asoka Babu, AGS, K.R. Yadav, Vice-President and Animesh Mitra, Circle Secretary, West Bengal met Shri Kuldeep Goyal, CMD on 26th October, 2009 and discussed the following issues.

Regularisation of Casual labourer. <>
Wages for Casual & Contract Workers. <>
Development of Services.
Meeting with BCG: - Com. V.A.N. Namboodiri, General Secretary, BSNLEU along with Coms. P. Asoka Babu, AGS, K.R. Yadav, Vice-President and Animesh Mitra, Circle Secretary, West Bengal met the Boston Consultancy Group (BCG) as per their invitation. The BCG Group along with Smt. Madhu Arora, GM, (Restrg). explained the projects being implemented like Kuber, Shikhar, Udam etc. We gave our opinions / Suggestions.

Wage Negotiation: - General Secretary met BSNL officers and demanded to fix the next meeting early. It is expected that the meeting will be fixed this week itself.

Vyas) called for Dharna at SSA Offices of BSNL throughout the country from 27th to 29th October, 2009 demanding 50% IDA Merger, Revision of Pension of BSNL Retirees etc. BSNLEU (CHQ) calls upon all Circle, District and Branch Secretaries to extend all help, support and solidarity and to participate in the programme. [13.10.2009]Brief of the wage negotiation meeting on 13th October 2009.

After detailed discussion in the wage negotiation meeting today ,13th October 2009, the management proposed the following:

1. 30% fitment with 10 year periodicity with 68.8% IDA for the present and raising to 78.2% with executives

2. If period of wage revision is reduced to executives, it will be done for non-executives also.

3. There can be a review after 5 years.

The Unions demanded review after 5 years without mentioning the periodicity.

The next meeting will take place after Diwali.
