[30.10.2009]Pay Anomaly Committee meeting:- The Pay Anomaly Committee meeting was held on 30-10-2009. Com V.A.N.Namboodiri GS and Com P.Asokababu AGS BSNLEU participated from the Staff side.

The necessity to form another Committee arose since the DoT rejected the agreement of the earlier Anomaly Committee. It stated that Revised Pay Rules and option for pay fixation from the date of next increment falling after 1-10-2000 for those promoted before 1-10-2000 are not applicable for settling the anomaly cases. As such the management stated that it is almost impossible to settle the issues. Management also pointed out that neither in MTNL nor for executives in BSNL it self such anomalies/aberrations could be settled.

The staff side pointed out that at the time of conversion of CDA pay scales to IDA pay scales itself it was assured by the management that these anomalies/aberrations will be sympathetically considered and settled. In the wage revision order (CDA to IDA) also it was mentioned. As such the management has to take suitable decision for early settlement.

After much discussion the official side was prepared to consider the issue of granting personal pay to the extent of the difference to the seniors after promotion of the junior to the higher grade. It will also be considered whether the senior in the higher grade can be given personal pay to the extent of difference between senior in the higher grade and junior in the lower grade.

The next meeting will be held after two weeks.

B.R. Jakhatia, V. Subburaman, P. Asokababu and Babu Singh to prepare a document in full justification of our claim to be put before management.

The meeting also decided to demand the management to hold the meeting of Wage Negotiation Committee urgently and settle wage revision.

[13.10.2009]Brief of the wage negotiation meeting on 13th October 2009.

After detailed discussion in the wage negotiation meeting today ,13th October 2009, the management proposed the following:

1. 30% fitment with 10 year periodicity with 68.8% IDA for the present and raising to 78.2% with executives

2. If period of wage revision is reduced to executives, it will be done for non-executives also.

3. There can be a review after 5 years.

The Unions demanded review after 5 years without mentioning the periodicity.

The next meeting will take place after Diwali.

NEW DELHI: With the CBI raids in the offices of the Telecommunication Ministry creating a tricky situation for minister A Raja, the Congress on Monday took the moral high-ground saying that it has ‘zero tolerance’ towards corruption.


This, of course, is the official line. Off record, senior Congress leaders said that they expected Tamil Nadu Chief Minister M Karunanidhi would not insist on ‘defending the indefensible’. Karunanidhi was an astute politician who would not expose his party or the UPA government to opposition mudslinging or allow a media witch-hunt to unroll, they said. The Congress is, in fact, waiting for Karunanidhi to take a call on the issue. A top DMK functionary is expected to meet Sonia Gandhi’s political secretary Ahmed Patel with a message from the CM.

For the moment, the Congress is sticking to a standard line for public consumption. “In the Congress, we are for transparency in public life. We espouse a policy of zero tolerance towards corruption,” party spokesperson Shakeel Ahmed said. Anticipating a united BJP-Left Opposition backlash in the Winter Session of Parliament on 2G spectrum allocation, the party tried to wash its hands off the issue. Ahmed insisted that ‘the relevant facts can only emerge from the government and not from the party’.

The party continued to maintain that taking action against Raja did not arise as his name did not figure anywhere and the raids were against some officials.

10/28/2009 6:40:00 PM There is no need to investigate from 2001. Even in 2001 first come first served policy was followed. It is not this policy in question. It is valuation. Will people recommeding investigation from 2001 will sell their property (land or gold ) in 2007 at the same price of 2001. So it is a question of VALUATION, VALUATION. Second license given to people who have no previous experience in Telecom and that too so many circles at such low VALUATION. Imeediately after getting license these companies enter into negociations to sell the stake and make HUGE windfall profit. That is what stinks. Raja may not have control of this but he is the catalyst in this. Investigation need not be from 2001 as some people are saying in this blog and the same posts in DINAMANI blog. This will only delay the investigation and make RAJA escape.

Whatever DOT says and whatever CBI wants to protect, I have reported 26 bribe transactions in BSNL Nagpur right from illegal telephones, illegal telephone exchanges and telephone on bribe. BSNL CMD should be and must be ashamed of INR 50 from 75 year old. Recently BSNL CMD has written to me - Your complaint has been forwarded to concerned unit. (Read to the one who takes bribe). This your complaint has been forwarded to concerned unit - CGM -PGM - Lineman is going since 5 years. If we have ZERO tolerance to corruption - I wish BSNL CMD's 5 years salary be rolled back. The BSNL decided to invite franchisees from private players for providing WiMax services. Raja’s method is to give BSNL 25 per cent of revenue while 75 per cent will go to the private player. The annual revenue from WiMax is expected to be Rs 900 crore, according to BSNL estimates. A total of 11 companies responded to BSNL’s WiMax franchisee allotment.

FIR charges ‘unknown’ DoT officials with criminal conspiracy
Neena Vyas Share · print · T+ The Central Bureau of Investigation’s first information report on the telecom licence and spectrum scandal has charged “unknown officials” of the Department of Telecommunications with carrying out a “criminal conspiracy” to award licences “for a heavy consideration” by “putting a “cap on the number of applicants against the recommendations of the TRAI” (Telecom Regulatory Authority of India).

Filed on October 21, the FIR, a copy of which was made available to the press by political sources, also charged these officials as having awarded licences on a first-come, first-served basis on 2001 rates without any competitive bidding.

A specific charge is that the government suffered an estimated loss of Rs.22,000 crore. A case has been made of favouritism. On September 24, 2007, through a press release, the DoT stated no new applications for licences would be accepted after October 1, 2007. Between September 25, and October 1, 2007, a large number of applications were received, but none accepted.

On January 10, 2008, letters of intent were issued to nine service providers for 122 telecom circles on the basis of applications received by September 25, 2007, thus showing them “favour.”

This was later justified by the Department saying that the applications received first would be processed first, and if found eligible, be given licences.

Then again, according to the FIR, an “arbitrary condition” was imposed saying that licences will be issued first to those depositing the fees first. It noted that favour was shown to some applicants to whom this information was leaked in advance so that they could get the money together and deposit it before others.

Without any valid reason, applications received after September 25, 2007, were rejected and licences given to a “few selected companies at nominal rate” causing “wrongful loss to the government of India and a corresponding gain to private persons estimated to be more than Rs.22,000 crore,” the FIR stated.

Open and shut case, says Jaitley
Bharatiya Janata Party leader Arun Jaitley described the scandal as an “open and shut criminal case.” He charged the CBI with attempting to “dilute the scale of the scandal” from roughly Rs. 60,000 crore to Rs.22,000 crore.

He said it was simple arithmetic. Taking up the illustration mentioned by the CBI in the FIR: A company named Swan was allotted licences for 13 circles for Rs.1,537 crore. It offloaded 45 per cent of equity in this shell company to a United Arab Emirates based company Etisalat for Rs.4,200 crore. The CBI calculated the loss to the government by deducting Rs.1,537 crore from Rs.4,200 crore — Rs.2,663 crore, and has done a similar exercise for all nine licences.

However, Mr. Jaitley pointed out that since 45 per cent of the equity stake was sold for Rs.4,200 crore, it was a matter of simple arithmetic that 100 per cent equity was worth more than Rs.8,800 crore and the loss was to the tune of more than Rs.7,200 crore in this case alone.

“If you look at each of the figures for the nine licences, the total figure comes to more than Rs.60,000 crore with each licensee having made a clean profit of around Rs.7,000 crore,” Mr. Jaitley emphasised.

Where is this competition leading us? According to analysts, such intensive competition will have negative impact on profit margins. Stock markets too have reacted negatively to these developments. There is a lot of buzz in the market around the impending round of consolidation. There have been predictions that this competition will lead to increased M&A activity in the markets especially among the small, regional and new operators.

It is doubtful that there would be a large scale domestic consolidation in the Indian mobile space in near future (though there might be some activity where large operators gobble up smaller and regional players). There are many reasons for it. First, according to Trai guidelines, new operators cannot participate in M&A activity before completing three years of operations. Second, large operators are looking outside domestic markets where there is scope for replication of their ‘Indian model’ of cost reduction – outsourcing and infrastructure sharing. Third, the tariff competition though predatory will lead to larger subscriber base overall. Fourth, M&A is risky – majority of research about the impact of M&A on firm performance shows that M&A may not realise desired results. Fifth, there are other opportunities to increase profit margins – data and enterprise applications.

In saturated telecom markets such as the US and Europe, data forms a larger proportion of ARPU (Average Revenue per User) compared to voice and there are no reasons for India to be any different. In fact, the mobile industry has already seen a 153 per cent year-on-year increase in the number of subscribers using mobile to surf the internet in 2009. At present, telecom operators in India are concentrating on increasing voice subscribers; it is only a matter of time before operators shift focus to increasing their share of revenues from data traffic. In next couple of years, there is a higher possibility of increasing rationalisation of data tariffs to stimulate usage of internet on mobile phones and other value added services.

There is a general criticism of future viability of value added services in India due to the absence of ‘killer app’ and delay in the roll out of 3G licence. No doubt 3G technology would increase the scope of value added services that can be provided to subscribers, but telecom operators can increase their share of revenues from data through mobile internet till the time 3G services are rolled out. And as far as developing that killer app is concerned, customer segmentation, that is, services targeted towards a niche market, will be the key to the success of value added services.

Value added services targeted at the rural subscribers would be another important focus area in next 3–5 years. The challenges for mobile operators in rural areas would be similar to those in urban areas –- falling revenues from voice traffic and strained profit margins. Given the low income levels, high sensitivity to price and low rate of literacy, rural India would spend on services that would improve their prospects of increasing income in the future.

Telecom operators have started offering value added services for enterprises like mobile application tools, vehicle tracking solutions, meter reading solutions etc. This segment is still in a nascent stage as enterprises are concerned about the security aspects of these services. The take-up rate is slow at present but it presents huge possibilities for the telecom sector.

For now it is too early to expect consolidation in this industry as mobile operators will first exhaust other opportunities. Rather it is possible that value added service providers in India might see M&A activity in the near future rather than the telecom sector.

by tthe ffourtth week off Octtober,, 2009..
One off tthe maiin diisputtes iis over tthe periiodiiciitty off agreementt.. The uniions wantt
ffiive years periiodiiciitty as iis beiing agreed iin otther PSUs.. The uniions iin otther PSUs
are makiing agreementt wiitth 5 years periiodiiciitty even iiff tthe ffiittmentt iis lless tthan
30% siince tthey know tthatt ttwo ffiive year agreementts off even 25% ffiittmentt wiillll gett
tthem 50% ffiittmentt iinsttead off 30% iin tten years.. Butt as ffar as BSNL emplloyees
are concerned we can nott agree tto lless tthan 30% ffiittmentt as a llarge number off
emplloyees have rettiired and are goiing tto be rettiired by 2012.. Hence we cannott
acceptt lless tthan 30% ffiittmentt..
Afftter hard bargaiiniing,, tthe managementt iin tthe llastt meettiing on 13tth Octtober has

iis tto be menttiioned as tten years.. 30% ffiittmentt on pay pllus 68..8% IIDA can be
giiven as iin tthe case off executtiives and iincrease ffrom 68..8% tto 78..2% can be
negottiiatted ffor botth.. The uniions wantted tthatt tthe periiodiiciitty need nott be
menttiioned as iin tthe case off executtiives.. Butt tthe offffiiciiall siide doesn’’tt agree and
iinsiistts on menttiioniing a 10 years periiodiiciitty ffor non-executtiives siince iitt iis an
agreementt.. We have demanded tthatt periiodiiciitty shoulld nott be made.. Thiis wiillll be
ffurtther diiscussed iin tthe nextt meettiing..

Govt allows foreign firms to bid for 3G auction

NEW DELHI: The government on Saturday said foreign firms would be allowed to bid for spectrum for third generation mobile services and will start auctioning the radio waves from January 14, 2010.

"Interested foreign entities are allowed to participate in the auctions directly and apply for licences subsequently," the revised Information Memorandum, giving details about eligibility criteria and time schedule said.

Foreign entities can operate telecom services in India only through an Indian subsidiary with not more than 74 per cent foreign share holding, subject to the approval of the Foreign Investment Promotion Board (FIPB).

The Department of Telecom (DoT) has said the auction of 3G spectrum would be carried out in four stages -- invitation stage, pre-qualification, auction and grant of spectrum.

The DoT would hold a pre-bid conference on November 16 and the mock auction would be conducted on January 11-12 next year.

"The auction of 3G spectrum would start on January 14, 2010," the DoT said, adding that this is an indicative time schedule and subject to revision.

According to the revised schedule, there is a slippage of over two weeks compared to the original plan as announced by the Empowered Group of Ministers.

Firms have to submit bids by Dec. 21 for a total of 71 blocks of spectrum put up for auction across 20 of India's 22 telecoms zones, according to a memorandum to prospective bidders.

The auction, which would introduce high-speed Internet and video downloads on mobile phones, was originally slated for January 2009 but was deferred to December after differences between the telecoms and finance ministries over the reserve price for the bids.

The government did not give a reason for the second extension.

The base price for 3G spectrum across the country is 35 billion rupees ($750 million), and Telecoms Minister Andimuthu Raja has said the government would net at least 250 billion rupees from the sale.

'Telcos inflating subscriber base'

NEW DELHI: An internal check conducted by Department of Telecom's (DoT) monitoring cell sometime back had found that most telecom operators were overstating their subscriber base, giving credence to allegations that big players were favoured with additional spectrum for free even when they didn't deserve it.

The revelations come at a time when the CBI has raided the offices of DoT to unearth nexus between its officials and telecom operators in awarding of licences.

Contrary to claims made by 14 telecom operators before the Cellular Operators Association of India (COAI) and TRAI that their net customer base added up to around 38 crore till April 2009, DoT found that their actual subscriber base was not more than 30 crore. However, leading players denied that they had misrepresented facts.

Three big players, Airtel, Vodafone and Reliance, have allegedly overstated subscribers by over a crore each. The government has been awarding additional spectrum solely on subscriber base claimed by these operators. Licences to Swan Telecom and Unitech had been awarded last year for nearly Rs 1,600 crore each.

A start up spectrum of 4.4MHz comes with the licence with a subscriber base of upto 5 lakh. For the allotment of next step of spectrum such as 6.2MHz or 7.2MHz, the boost in subscriber base of an operator has to be by three to five times of the start up figure. For commanding a spectrum of 14.2 MHz, an operator has to have additional 65 lakh to a crore subscribers.

Variations have largely been noticed in the monthly data provided by these opearators to DoT's vigilance and monitoring cell along with other agencies such as Intelligence Bureau, DRI, ED, etc.

The nearly eight crore extra connections is more than the combined user bases of 50% of telecom operators in the country including Spice Telecon, Tata Teleservices, BPL, Shyam Telecom, MTNL and HFCL Infotel. In fact, like the big boys, the smaller players too have variations in their customer base.

Most operators denied the charge. A Bharti Airtel spokesperson said, "As a responsible company, Bharti Airtel complies with all the regulatory guidelines prescribed by the Indian government. The company deploys world-class systems and processes to monitor subscriber information." A Vodafone spokesperson said the company observed highest standards of reporting.

A spokesperson of RCOM said since there were different parameters followed by Trai and DoT, there could be a possibility of variation in numbers. He, however, said the company had sent in its response to the authorities conducting audit. A senior BSNL official said since different circles reported data separately, there could be a possibility of mismatch.

• The customer can recharge his account online from the BSNL portal after purchasing the voucher either through BSNL CSC or other retail outlets.

• While the account under limited Plans will be governed by validity as well as usage amount, the account under Unlimited Plans will be governed by validity period only . The renewal of unlimited plan will create new validity period on the date of renewal as per the value (MRP) of the Unlimited Plan Voucher, together with the related bandwidth speed opted by the customer from the Plans indicated at Para-C(1). For example, if a customer availing Pre-paid 256 Kbps account (unlimited) renews his/her account with BB R_UL 1200 voucher and opts for speed of upto 512 kbps at the time of renewal, charging as per the new opted bandwidth will start and new validity of 30 days will be applicable.

• In case the customer opts for migrations from unlimited plan to limited plan or vice versa his/her validity/balance shall not be carried forward. The account will be treated as a fresh account. However, the customer will be able to retain his user account.
