[10.07.2009] Utter Confusion ! They don’t know what they demand:- It is observed at FNTO (CHQ) website that they demanded to BSNL Management: “IDA Pay Scales of the non-executives w.e.f. 01.01.2007 in the same line and fixation formula adopted for executives without any periodicity.”

This actually means (apart from periodicity), they don’t want benefit of merger of 50% IDA, which has already been approved by DPE but not yet implemented for BSNL executives. Moreover, they want that non-executives pay scales be constructed in relation to present E-1 minimum pay of Rs.16,400/-, since proposed E-1 A pay scale has not yet been granted.

THEY MAY INSIST ON LOWER BENEFIT FOR NON-EXECUTIVES, BUT BSNLEU CAN’T COMPROMISE ON LONG TERM INTEREST OF THE EMPLOYEES.

In their memorandum supposed to be signed by employees, they demanded: “Kindly award pay scales as recommended by Second Pay Review Committee.”

What a joke indeed !

2nd Pay Review Committee was for executives and its recommendations confined to executives only. No pay scale for non-executives recommended by 2nd Pay Review Committee.

[10.07.2009]Kerala circle convention against Disinvestment & Privatisation

A circle level convention attended by a large number of workers was held at Bank Employees Union Hall, Thiruvananthapuram on 8th July, 2009. Com. A.V. Kuriakose, Circle President, BSNLEU presided. Com. T. Sivadasa Menon, former Minister, Kerala State, and CITU leader inaugurated the convention. He called upon the workers to be prepared for sustained struggle against the onslaughts on the working-class including disinvestment and privatization. Com. V.A.N. Namboodiri, General Secretary in his speech emphasized the need for united struggles to save BSNL from IPO and disinvestment. Coms. J.N. Mishra, All India President, BSNLEU, R. Muralidharan Nair, AGS and K. Mohanan, Circle Secretary also addressed the meeting.

[10.07.2009]Trade Union Class at Trivandrum: - Three Days Trade Union Class was organized by BSNLEU for its All India office-bearers, Circle Secretaries and Senior leaders at EMS Academy, Thiruvananthapuram from 6th to 8th July, 2009.

The classes were taken by Com. M.K. Pandhe, President, CITU, Dr. Prabhat Patnaik, Vice-Chairman, Planning Commission, Kerala, Com. Prabir Purkayastha, Delhi Science Forum, Com. Prasanna Kumar, State Secretary, CITU, Karnataka and Com. V.A.N. Namboodiri, General Secretary, BSNLEU. The subjects included Global Recession and its impact on Indian economy, The present telecom scenario, Public Sector & challenges and Organization & tasks.

The classes were appreciated by all participants. Such classes will be organized at Circle / District levels also. The Reception Committee headed by Coms. K. Mohanan, Circle Secretary, Kerala and R. Muralidharan Nair, AGS, CHQ made all arrangements for comfortable accommodation and food. Our heartfelt thanks to them. <>

[10.07.2009]Com. Om Vyas No more: - Com. Om Vyas, renowned poet and BSNLEU leader of Ujjain breathed his last at Appollo Hospital, Delhi. He was brought to the hospital after a car accident. Three other poets who were in the car had died on the spot. Com. Vyas was very active in the union and had held many important posts in the union. Earlier CHQ had intervened to undo his victimization by the local administration.

[02.07.2009]Defeat the Disruption:- Certain unions in collaboration with management are circulating a copy of representation to be sent to CMD BSNL declaring willingness to accept what has been offered by management on wage revision. This is nothing but a trap against the interests of the BSNL Workers for getting a better wage revision like in other major PSUs.

Earlier, a similar representation accepting managements offer of interim advance (4 months) floated by these unions were completely defeated by the workers. United Forum through a strike agreement got 6 months advance and new HRA rates for workers.

Now again, the present nefarious move has also to be defeated. Mir Jafars and Jayachandras can not allowed to cheat the workers.

Promotion Policy: General Secretary pointed out that the file is pending with Secretary, DoT and requested CMD,BSNL to ensure early approval by DoT and implementation. CMD assured to do the needful early.

Wage Revision: General Secretary requested CMD that Director (HRD) be appointed as the Chairman of the Wage negotiation committee in place of Shri R.K.Batra, PGM (IR) who retired on 30-06-2009. CMD agreed to examine the proposal in consultation with Director (HRD).

GS met GM (Estt.) and discussed the following: (1) Prequalifying examination for TMs for promotion to TTA. (2) Grant of HRA at 10 % to the dependent areas of Gurgaon . GM agreed to take necessary action in the matter.

TUI Congress at Brazilia, Brazil: - Com. P. Abhimanyu, Dy. Examination for promotion to TTA and TM being notified: - Com. V.A.N. Namboodiri, General Secretary, BSNLEU met Shri D.P. De, GM (Estt.) on 24.06.2009 and discussed about the holding of examination for promotion to TTA and TM as assured in National Council Meeting. GM (Estt.) stated that the notifications for the above two examinations will be issued shortly.

[16.06.2009]Meeting with GM (Estt.) BSNL CO: - Com. V.A.N. Namboodiri, General Secretary, Com. K.R. Yadav, Vice President, Com. P. Asokababu, AGS, and Com. Swapan Chakraborty, AGS, BSNLEU met Shri D.P. De, GM (Estt.), BSNL CO today (16.06.2009) and discussed the issues related to compassionate appointments and casual labour. The GM (Estt.) stated the following:-

Compassionate appointment cases are being settled as per priority, based on date of death of the expired official. Settlement of compassionate appointment cases will be expedited.

On our demand for payment of advance for TSMs pending their wage revision, a proposal was put up for the consideration of the management.

Revision of casual labour wages on CDA pattern is under consideration.

On the demand of the union for regularization of casual labour management appointed a committee to examine the same.

[11.06.2009]Promotion Policy and DA merger for retirees: -Com. P. Asokababu, AGS and Com. K.R. Yadav, Vice President, BSNLEU met the DDG (Estt.), DoT, Shri A.K. Das today (11.06.2009) and discussed the above issues, and the following is the position:-

(1) Promotion policy is under active consideration and DoT’s approval is likely to be given early.

(2) After DPE’s objection regarding DA merger for retirees (for those retired before 01.01.2007), the DoT’s legal call was consulted and now the case is being processed for forwarding to Department of Pension for its approval.

[10.06.2009]Committee on Change of Designations met on 09.06.2009:- Committee to recommend changes of Designation met yesterday. The Staff Side suggested new designation for certain cadres. Next meeting is fixed for 16.06.2009. Coms. V.A.N. Namboodiri, P. Abhimanyu and other committee members attended from staff side.

[09.06.2009] Meeting with CMD: - Com. V.A.N. Namboodiri, General Secretary, BSNLEU met Shri Kuldeep Goyal, CMD BSNL, on 8th June 2009 and discussed the following issues.

Expediting Tender for 63 million GSM lines.
Introduction of Vehicle Policy.
Implementation of Maternity Leave, Child Care Leave etc. in BSNL. For Details <>
Wage Negotiation meeting on 05.06.2009:- In the meeting of the Wage Negotiation Committee held on 05.06.2009, the management side informed that the issue of 5 year periodicity for wage agreement was referred to DoT on 03.06.2009 for its approval. The union pressed the management to agree for fitment benefit on par with top executives, on Pay+78.2% of pay instead of Pay+68.8% of pay. The Management Side said that for BSNL executives, the issue of granting fitment benefit on Pay+78.2% of pay was not yet decided by the management. Union said that in several PSUs this was already accepted and implemented for the executives. Management agreed to examine. Discussion took place on the demands like increment at the rate of 5% on basic pay, Grant of two increments for pay fixation on promotion, perks and allowances on par with executives and pension scheme for BSNL recruitees. The discussion was inconclusive.

Com. V.A.N. Namboodiri, General Secretary, Com. P. Asokababu, AGS, and Com. K.R. Yadav, Vice President, represented the BSNLEU. Next meeting of the committee is likely to be held in next week.

[02.06.2009] Wage Revision discussions to resume:- The Staff Side walked out from the meeting of the Wage Revision Committee on 22nd April, 2009, due to the negative attitude adopted by the Management, on the question of Interim Relief and implementation of the New HRA Rates. However, a settlement is reached between the United Forum and the management on 18.05.2009, in the back drop of the two day's strike notice issued by the United Forum. Consequent upon this settlement, management has fixed date for holding the meeting of the Wage Revision Committee on 5th June, 2009.

[02.06.2009] Meeting of the Steering Committee of the United Forum:- A meeting of the Steering Committee of the United Forum is held in the National Council Office, on 2nd June, 2009. Coms. V.A.N. Namboodiri, GS, P. Abhimanyu, Dy. GS and Swapan Chakraborthy, AGS represented BSNLEU. Com. V. Subburaman, GS, TEPU, Com. N.D. Ram, National President SEWA BSNL, Com. Suresh Kumar, GS, BSNL MS, Com. Hakkam Singh (SNATTA) participated. Based on the inputs given by the management, detailed discussion took place on the change of designation of No-Executives. It was decided that one more round of discussion in the Steering Committee will take place on 8th June, 2009, before discussion with the Management.

[02.06.2009] Meeting of the Joint Committee for change of designations of Non-Executives:- The first meeting of the Joint Committee for change of designations of Non-Executives took place on 01.06.2009 at 1100 hrs. Staff Side is represented by Com. V.A.N. Namboodiri, GS, BSNLEU, Com. P. Abhimanyu, Dy. GS, BSNLEU, Com. V. Subburaman, GS, TEPU and Com. Hakkam Singh (SNATTA). The official side is represented by Shri Deepak Aggarwal (DGM Restg.) and Shri P.K. Mishra (DGM, Estt.). Informations relating to the various cadres existing is BSNL and their respective strength were handed over to the Staff Side. A preliminary discussion took place on the basics of the change of designation. It is decided that the committee shall meet again on 8th June, 2009. The last date for submission of the committee's report is fixed as 15th June, 2009.

[01.06.2009] Com. V.A.N. Namboodiri, GS, BSNLEU discussed the following issues with DoT Officers

1). 50% IDA Merger for BSNL retirees: - As per legal cell (DoT) advise, the matter is referred to DoP&W, Govt. of India. CHQ is perusing the case. 2). Promotion Policy for Non-executives: - The matter is being examined by DoT. General Secretary, BSNLEU demanded for early approval.

[15.05.09] Revised Pension Rules as per VI CPC for BSNL Retirees issued:- As assured by Shri R. Ashok, Member (Finance) to Com. V.A.N. Namboodiri, General Secretary, BSNLEU, orders have now been issued on 14.05.2009 by DoT raising DCRG limit from Rs. 3.5 to Rs. 10 lakhs and allowing revised Pension rules regarding Commutation table, emoluments, qualifying service etc. as per VI CPC recommendations.

[01.05.09] ONE HOUR WALK OUT ON 04.05.2009 : - BSNL management has arbitrarily issued order on 30.04.2009, granting very meager amount of Interim Relief, equivalent to 4 months basic pay. CHQ BSNLEU condemns the decision of the management, granting paltry amount as IR, as well the arbitrary manner in which the order is issued.

United Forum of BSNL unions has given call to BSNL employees to walk out from duty/office, for one hour on Monday the 4th May 2009. Mobilise the workers to give a fitting reply to the BSNL management’s high handedness.

[30.04.09]What is our demand on Interim Relief ?

Interim Relief is usually granted when the due wage revision is delayed. For Central Public Sector employees, wage revision is due w.e.f. 01-01-2007. Already, more than 27 months have elapsed. Management should have offered IR when there has been such long delay. Most of the other PSUs have granted either interim relief or pay advance much earlier. Even after BSNLEU/United Forum of BSNL Unions demanded interim relief, the management did not take any decision. The demand of the UF is that Interim Relief of 50% of pay or Rs. 3000/- whichever is more be paid. If it is pay advance, Rs. 50,000/- to Rs.80,000/- be paid. This is similar to what is paid in the other PSUs.

The management first offered two months basic pay as advance. This will come to Rs.8,000/- at the lowest level. After much discussion in the meeting on 29-04-09, CMD offered 4 months basic pay ie. Rs. 16,000/- at the lowest level. We could not accept such very meagre advance. The workers are eligible for increase for the last 27 months since 01-01-07.Even if an advance of Rs. 1000/- p.m. is calculated, then it will come to Rs. 27,000/.It is pertinent to note here that in the conversion from CDA to IDA in 2000, all officials got more than Rs.1500/- p.m. But the management is not prepared to see reason and comparison with other PSUs and concede our demands.

United Forum is not adamant that whatever it demanded should be fully accepted. But there is always a bench mark below which it is impossible to agree.

When even the lowest executive is being paid Rs. one lakh as arrears (40% already paid and 60% being paid in 2008-09), leave alone the top executives who are being paid arrears of about 6 lakhs or so, why the non-executives can not be paid even half of it? Can we accept such meagre offer? Certainly not.

Let us seriously prepare for the two days strike on 19-20th May 2009. Meet each and every worker and explain our demands and the management's negative response.

Although they've long since finished reading the last book, Harry Potter fans have had to wait an extra long time for the new film and video games. When Warner Bros. Pictures pushed back the already-completed film, Harry Potter and the Half-Blood Prince, from last fall to a July 15 release, Electronic Arts had to hold off on the new games that further explore the movie and book storyline. Well, the wait is finally over on both fronts.

EA has conjured up Harry Potter games for every platform, offering high definition visuals on the PC, Xbox 360 and PlayStation 3 games and motion-controlled mano-a-mano spell casting multiplayer magic in the Wii game. The Nintendo DS game makes full use of the touch screen and dual screens. But don't take our word for these new games, listen to what the cast that brings these Harry Potter characters to life in the new movie had to say about EA's latest virtual creations.

Daniel Radcliffe, who brings Harry Potter to life, and Rupert Grint, who plays Ron Weasley, got a chance to check out Harry Potter and the Half-Blood Prince and offer their two cents on the interactive adventure.

What do you think the fans will like about the video game of Harry Potter and the Half-Blood Prince?

Daniel Radcliffe: I think, in terms of what will excite the fans is the effort we've always made when we're making the films is to make them as close to the books as we can; and you can see in the game that huge amounts of effort goes into making it like the films: as in, as much of the sets and the characters and the way we look and the way we act. It's a lot of effort - it's very obvious – that goes into that.

What do you think of your in-game likeness?

Daniel Radcliffe: Using various technologies, that I will never understand, they have somehow managed to take my face and a performance and transpose it onto the screen, which is incredible. And again, you're less distracted by the slightly more rigid movement of the older characters, and it just makes the whole thing sort of flowing, I think.

Rupert Grint: They're starting to look a lot - scarily - a lot like us now! And I saw some of the pictures of us and some of the rough animations and it is really scary! Even the way it moves is really strange. They've come on so much, it's really, really good to see.


Do you ever go looking for your movie character when you play the game? Do you ever have that "wow, that's me in the game" moment?

Daniel Radcliffe: I think, in terms of when I play the games, I don't necessarily look at the characters and say, "oh my god, that's me." I do feel a huge amount of responsibility to succeed within the game. Because I do feel I will be letting myself down, as well as the fictional character, if I do badly.

What do you particularly like about playing the video game?

Daniel Radcliffe: The thing I like about the games is it gives me a chance to feel like I'm really performing the spells. Because when you do them on film with your wand, just nothing comes out; it's just a stick! Whereas, you do feel slightly more involved when you have a reaction from the screen in the game.

LONDON (MarketWatch) -- Vodafone Group shares declined in a broadly higher London equity market on Tuesday after UBS downgraded its stance on the wireless telecom giant.

On Tuesday UBS downgraded the telecom firm to neutral from buy and said that, given its expectation for poor key performance indicators and cuts to consensus estimates, it was introducing a short-term sell rating.

"Economic pressures, market-share loss and exchange rates have combined to put pressure on our earnings estimates for Vodafone," the broker said.

It is expecting European revenue at the group to come under additional pressure with a fall of 5.5% due to an increased termination rate in Germany and the fact that the U.K. number was flattered by a one-off impact from an accounting change last quarter.

Morgan Stanley, in a note on the firm also out Tuesday, said that it expects worse results in Germany and the Netherlands due to termination-rate drags.

Modestly worse trends are expected in Spain, Greece, the U.K. and Italy due to cyclical and competitive factors, the broker said.

Still it also said "we believe that there is a reasonable chance that the first quarter forms the low point of the current decline, or at least that the second quarter records a figure comparable to the first quarter, with less negative quarters ahead." The firm will release an update on July 24.

Overall, the U.K. FTSE 100 index /quotes/comstock/23i!i:ukx (UK:UKX 4,233, +30.91, +0.74%) climbed 0.7%, or 30.09 points, to 4,232.22.

Other European shares were also higher, while U.S. stock futures were advancing ahead of results from U.S. banking giant Goldman Sachs due out later in the session See Europe Markets.

Metal stocks and banks were helping the advance in London, with shares of platinum extractor Lonmin /quotes/comstock/23s!a:lmi (UK:LMI 1,072, +87.00, +8.83%) up 6.1% and shares of Lloyds Banking Group /quotes/comstock/23s!a:lloy (UK:LLOY 66.67, +2.27, +3.52%) /quotes/comstock/13i!lyg/quotes/nls/lyg (LYG 4.28, +0.05, +1.18%) up 4.1%.

Both sectors are perceived as closely tied to economic growth and there was some better news on the U.K. economy on Tuesday, with data showing that retail sales rose by more than expected in June.

Another gainer in the top London index was food and household goods group Unilever /quotes/comstock/23s!e:ulvr (UK:ULVR 1,463, +10.00, +0.69%) /quotes/comstock/13*!ul/quotes/nls/ul (UL 23.64, +0.38, +1.63%) , with shares of the firm up 1% at 1,467p.

J.P. Morgan upgraded the firm to overweight from neutral, saying the company has the potential to grow earnings per share by between 10% and 11% a year.

The group said its price target is 2,000p a share or around 40% above current levels.

"While this valuation should be earned through building a consistent track record, we think the market could start discounting early signs of an earnings turnaround," it added.

Soft-drinks maker Britvic /quotes/comstock/23s!e:bvic (UK:BVIC 304.50, +7.25, +2.44%) advanced 2.1% outside the top index.

The firm said that revenue rose 5.9% to 249.1 million pounds in the 12 weeks to July 5, as brands drove growth. Fiscal-year earnings are now expected to top expectations, the firm said.

BSNL is committed to fight against corruption by helping management in creating transparent, honest and efficient organizational culture through the system improvement, awareness, timely detection and speedy investigation of mal-practices with impartiality and professional competence.


BSNL Vigilance is headed by Shri Sat Paul, IRS, Chief Vigilance Officer. BSNL Vigilance Wing plays an advisory role the various disciplinary authorities in BSNL. It also serves a link between BSNL, Central Vigilance Commission , Central Bureau of Investigation and Ministry IT& Communication . The main functions of the BSNL vigilance are to check and eradicate corruption which also include collecting intelligence about corrupt practices committed or likely to be committed within the BSNL, investigating or causing an investigation to be made into verifiable allegations reported to it, processing investigation reports for further consideration of disciplinary authority concerned; referring the matters to the Central Vigilance Commission for advice wherever necessary, taking steps to prevent practices of misconduct etc. Thus the function can be divided into two parts, namely :-


(i) Preventive Vigilance :

Even though detection and punishment of corruption and other mal-practices are certainly important, what is more important is taking preventive measures instead of hunting for the guilty in the post-corruption stage. Therefore, BSNL Vigilance takes various measures to prevent the corruption which include :

(a) To examine in detail the existing Rules and Procedures of the Organisation and ensure its implantation with a view to eliminate or minimize the scope for corruption or malpractices;

(b) To identify the sensitive/corruption prone area in the Organisation and keep vigilant eye on personnel posted in such areas;

(c) To plan and enforce surprise inspections and regular inspections to detect the irregularity, system failure and existence of corruption or malpratices;

(d)To prepare a list of officers of doubtful integrity and surveillance over them;

(e) To prepare Agreed List in consultation with the CBI;

(f) To ensure periodical rotation of staff;

(g) To ensure observance of Conduct Rules relating to integrity of the Officers, like :
(i) The Annual Property Returns,
(ii) Gifts accepted by the officials,
(iii) Benami transactions,
(iv) Regarding relatives employed in private firms or doing private business etc.

(ii)Punitive Vigilance :

The functions of BSNL Vigilance on the Punitive vigilance aspect are as follows :

(a) To receive complaints from various sources and scrutinize them with a view to find out if the allegations involved a vigilance angle.;

(b) To investigate or cause an investigation to be made into such specific and verifiable allegation in the complaint received directly or forwarded by the Central Vigilance Commission or CBI or Ministry or CMD, Board of Directors or any other Government or BSNL authority.

(c) To process the investigation report expeditiously for obtaining orders of the competent authorities about further course of action to be taken and also obtaining CVC advice on the investigation report wherever necessary.

(d) To ensure that charge sheet, statement of imputations, lists of witness and documents etc. are carefully prepared and copies of all the documents relied upon and the statements of witnesses cited on behalf of the disciplinary authority are supplied to the charged officer along with the charge-sheet;

(e) To ensure that all documents required to be forwarded to the Inquiry Officer are carefully sorted out and given promptly;

(f) To ensure that there is no delay in the appointment of the Inquiry Officer, and that no dilatory tactics are adopted by the charged officer or the Presenting Officer;

(g) To ensure that the processing of the Inquiry Officer's Reports for final orders of the Disciplinary Authority is done properly and quickly;

(h) To scrutinize final orders passed by the Disciplinary Authorities subordinate to the Ministry/Department, with a view to see whether a case for review is made out or not;

(i) To see that proper assistance is given to the C.B.I. and other disciplinary and enforcement agencies in the investigation of cases entrusted to them or started by them on their own;

(j) To take proper and adequate action with regard to writ petitions filed by charged officers;

(k) To ensure that the Central Vigilance Commission is consulted at all stages wherever it is required to be consulted and that as far as possible, the time limits prescribed in the Vigilance Manual for various stages is adhered to;

(l) To ensure prompt submission of returns to the Commission;

(m) To ensure that the competent disciplinary authorities do not adopt a dilatory or a lax attitude in processing vigilance cases, thus deliberately or otherwise helping the charged officials , particularly in cases of officers due to retire;

(n) To ensure that cases against the charged officials on the verge of retirement do not lapse due to time-limit for any reason and that the orders passed in the cases of retiring officers are implemented in time; and

(o) To ensure that the period from the date of serving a charge-sheet in a disciplinary case to the submission of the report of the Inquiry Officer, should, ordinarily, not exceed six months.

What is a ‘Navratna’ Company?

The Government, from time to time confers Navratna status on Central Publilc Sector Enterprises (CPSEs) once they fulfill certain stipulated criteria. Recently, Shipping Corporation of India Ltd. was granted Navratna status making it the 17th member of the elite Navratna club.

‘Navratna’ literally means ‘nine jewels’. The Government had identified nine Public Sector Enterprises (PSEs) in July 1997 that had comparative advantages and potential to emerge as global giants as Navratnas. These are: BHEL, BPCL, GAIL, HPCL, IOC, MTNL, NTPC, ONGC, and SAIL. These PSEs were given enhanced autonomy and delegation of powers to incur capital expenditure, to enter into technology joint ventures/strategic alliances, to effect organizational restructuring, to create and abolish below Board level posts, to raise capital from domestic and international market, to establish financial joint ventures and wholly owned subsidiaries, etc. Over the years, many more CPSEs were conferred Navratna status as they fulfilled the required criteria.

The enhanced powers presently delegated to the Boards of Navratna PSEs broadly include:

viii) To establish financial joint ventures and wholly owned subsidiaries in India or abroad, with certain limitations; and

ix) Mergers and acquisitions subject to certain conditions.

Performance of all Navratana Companies is reviewed by an Apex Committee from time to time. The proposals for granting Navratna status to CPSEs are received through concerned administrative Ministries/Departments. PSEs fulfilling the above criteria are generally granted Navratna status.

FUNCTIONS

BSNL is committed to fight against corruption by helping management in creating transparent, honest and efficient organizational culture through the system improvement, awareness, timely detection and speedy investigation of mal-practices with impartiality and professional competence.


BSNL Vigilance is headed by Shri Sat Paul, IRS, Chief Vigilance Officer. BSNL Vigilance Wing plays an advisory role the various disciplinary authorities in BSNL. It also serves a link between BSNL, Central Vigilance Commission , Central Bureau of Investigation and Ministry IT& Communication . The main functions of the BSNL vigilance are to check and eradicate corruption which also include collecting intelligence about corrupt practices committed or likely to be committed within the BSNL, investigating or causing an investigation to be made into verifiable allegations reported to it, processing investigation reports for further consideration of disciplinary authority concerned; referring the matters to the Central Vigilance Commission for advice wherever necessary, taking steps to prevent practices of misconduct etc. Thus the function can be divided into two parts, namely :-


(i) Preventive Vigilance :

Even though detection and punishment of corruption and other mal-practices are certainly important, what is more important is taking preventive measures instead of hunting for the guilty in the post-corruption stage. Therefore, BSNL Vigilance takes various measures to prevent the corruption which include :

(a) To examine in detail the existing Rules and Procedures of the Organisation and ensure its implantation with a view to eliminate or minimize the scope for corruption or malpractices;

(b) To identify the sensitive/corruption prone area in the Organisation and keep vigilant eye on personnel posted in such areas;

(c) To plan and enforce surprise inspections and regular inspections to detect the irregularity, system failure and existence of corruption or malpratices;

(d)To prepare a list of officers of doubtful integrity and surveillance over them;

(e) To prepare Agreed List in consultation with the CBI;

(f) To ensure periodical rotation of staff;

(g) To ensure observance of Conduct Rules relating to integrity of the Officers, like :
(i) The Annual Property Returns,
(ii) Gifts accepted by the officials,
(iii) Benami transactions,
(iv) Regarding relatives employed in private firms or doing private business etc.

(ii)Punitive Vigilance :

The functions of BSNL Vigilance on the Punitive vigilance aspect are as follows :

(a) To receive complaints from various sources and scrutinize them with a view to find out if the allegations involved a vigilance angle.;

(b) To investigate or cause an investigation to be made into such specific and verifiable allegation in the complaint received directly or forwarded by the Central Vigilance Commission or CBI or Ministry or CMD, Board of Directors or any other Government or BSNL authority.

(c) To process the investigation report expeditiously for obtaining orders of the competent authorities about further course of action to be taken and also obtaining CVC advice on the investigation report wherever necessary.

(d) To ensure that charge sheet, statement of imputations, lists of witness and documents etc. are carefully prepared and copies of all the documents relied upon and the statements of witnesses cited on behalf of the disciplinary authority are supplied to the charged officer along with the charge-sheet;

(e) To ensure that all documents required to be forwarded to the Inquiry Officer are carefully sorted out and given promptly;

(f) To ensure that there is no delay in the appointment of the Inquiry Officer, and that no dilatory tactics are adopted by the charged officer or the Presenting Officer;

(g) To ensure that the processing of the Inquiry Officer's Reports for final orders of the Disciplinary Authority is done properly and quickly;

(h) To scrutinize final orders passed by the Disciplinary Authorities subordinate to the Ministry/Department, with a view to see whether a case for review is made out or not;

(i) To see that proper assistance is given to the C.B.I. and other disciplinary and enforcement agencies in the investigation of cases entrusted to them or started by them on their own;

(j) To take proper and adequate action with regard to writ petitions filed by charged officers;

(k) To ensure that the Central Vigilance Commission is consulted at all stages wherever it is required to be consulted and that as far as possible, the time limits prescribed in the Vigilance Manual for various stages is adhered to;

(l) To ensure prompt submission of returns to the Commission;

(m) To ensure that the competent disciplinary authorities do not adopt a dilatory or a lax attitude in processing vigilance cases, thus deliberately or otherwise helping the charged officials , particularly in cases of officers due to retire;

(n) To ensure that cases against the charged officials on the verge of retirement do not lapse due to time-limit for any reason and that the orders passed in the cases of retiring officers are implemented in time; and

(o) To ensure that the period from the date of serving a charge-sheet in a disciplinary case to the submission of the report of the Inquiry Officer, should, ordinarily, not exceed six months.

What is a ‘Navratna’ Company?

The Government, from time to time confers Navratna status on Central Publilc Sector Enterprises (CPSEs) once they fulfill certain stipulated criteria. Recently, Shipping Corporation of India Ltd. was granted Navratna status making it the 17th member of the elite Navratna club.

‘Navratna’ literally means ‘nine jewels’. The Government had identified nine Public Sector Enterprises (PSEs) in July 1997 that had comparative advantages and potential to emerge as global giants as Navratnas. These are: BHEL, BPCL, GAIL, HPCL, IOC, MTNL, NTPC, ONGC, and SAIL. These PSEs were given enhanced autonomy and delegation of powers to incur capital expenditure, to enter into technology joint ventures/strategic alliances, to effect organizational restructuring, to create and abolish below Board level posts, to raise capital from domestic and international market, to establish financial joint ventures and wholly owned subsidiaries, etc. Over the years, many more CPSEs were conferred Navratna status as they fulfilled the required criteria.

The enhanced powers presently delegated to the Boards of Navratna PSEs broadly include:

In connection to the above subject, I am inviting your kind attention to the following :

Trade Union actions were launched by BSNL workers alliance. NFTE BSNL and NUBSNLW were the main participants in this Trade Union actions at CHQ/ Circle and SSA Level. Day Long Dharna was observed on 03.07.2009 & One Day Hunger Strike was observed on 06.07.2009 in Gujarat Circle also.

In this context, I would like to invite your kind attention to the contents of BSNL Corporate office letter cited under reference where in it is clearly mentioned that
" Management is obliged to hold dialogue and enter in to an agreement only with the Majority Representative Union of Non-Executive Employees".

Request was made to the convener, BSNLWA vide GM (SR), BSNL, Corporate Office Letter of Dtd. 26.09.2009 to withdraw Trade Union Actions. At the same time, all Circle Heads were requested to take suitable steps in accordance with the instructions issued from time to time to ensure uninterrupted services to our Customers and maintenance of our Services, Office Discipline/decorum. Corporate Office has also requested all Circle Heads to apply " NO WORK NO PAY " against agitating Employees.

Looking to the above, I would like to request you to issue suitable instructions to all SSA Heads of Gujarat Circle to identify the Agitating Employees on Dtd. 03.07.2009 & 06.07.2009 and take suitable Disciplinary Action against the Agitating Employees immediately in the wider interest of maintenance of uninterrupted services, maintenance of Office Discipline/decorum and image of BSNL as a whole in Gujarat Circle.

In the Sotomayor CNN poll only 47% want to see her confirmed, a very low number for a Supreme Court nominee chosen by a supposedly extremely popular President. though CNN continues to try to slant any news regarding Obama in the best possible light. They have skewed the link to their poll online as " Sotomayor confirmation favored". Their headline tells us "almost half want Sotomayor confirmed".

Independents, the most important bloc are split which is also bad news for both Obama and Sotomayor and could be equally bad news for Democrats who will almost certainly confirm her . The question will be whether Republicans can score points during the confirmation hearings and exact a political price.

Regarding CNN;s polling, there is a large disparity between their poll that says 72% feels Obama "inspires confidence" and their poll that shows that only 47% has confidence in his decision to nominate Sotomayor. It calls into question the accuracy of CNN's polling and whether Obama's positive numbers in other polls are skewed.

The fact that only 70% of Democrats want to see her confirmed is also a poor number. One would think the number would be 90% or higher if her confirmation was based purely on partisanship..

Sotomayor stands to have problems during her confirmation with the recent Supreme Court reversal of her lower court decision on race regarding the firefighters in New Haven. There are also indications that a number of constitutionally challenged Republicans are going to question her about decisions regarding guns in which they will try and paint her as being anti 2nd amendment. Given that the 2nd amendment has nothing to do with an individual's right to own a gun and that the idea that it does is based on pure myth and constitutional stupidity, Sotomayor's record on gun law cases will have little impact on her confirmation though I'm sure there will be both Democrats and Republicans who will make constitutional fools of themselves regarding the 2nd amendment.

But for now, the constitutionality of her decisions regarding guns will not be a problem,unlike her decision regarding race and the New Haven firefighters, since none of her decisions regarding gun laws have been reversed by the Supreme Court or to the best of my knowledge even appealed.

The Democrats have the votes to confirm her and in all liklihood will do so barring anything unforseen. But the question that will emerge from the hearings will be, at what price?
